Bill McEwen testified on August 7, 2003 that Amiga is "insolvent" and has "about one hundred dollars" in their checking account in a recent deposition in the ongoing Thendic-Amiga lawsuit.
McEwen took off for Montana for "medical reasons" - delaying the depostion and discovery as mandated by the US Court.
"He would not identify the name of his condition, admitted there are no witnesses, nor would he identify the names of his caretakers. He could not even identify the name of the individual who referred Mr. McEwan to his mystery caretakers stating, the referral came from a "horse riding acquaintance". (Declarationn of Hughes - Ex.3 Deposition of McEwen P.9 L. 3-18.
McEwen states that Amiga owes him over $740,000 - and that "1.8 (million) is owed to the three officers of the company. The three founders I should say."
Proposed sanctions include the "Amiga is ordered to integrate its Digital Environment (DE) Operating system into Pegasos, Morphos (Pegasos" existing operating system), or any derivative or descendant thereof. Moreover, Amiga shall honor any and all requests for integrationn made by Thendic, Genesi Sarl or their respective agents, officers and/or representatives to integrate the Amiga DE into any product or future product of Thendic, Genesi Sarl,Pretory USA, Inc., Pretory Net, Inc., Pretory S.A. and anyy of Thendic's Affiliates or related or subsidiary companies per the OEM Software Agreement." This is due for consideration on or around October 3, 2003.
