Amigo follows up on serious allegations about H&P and says: "I also just asked Unisys as it says here, and am waiting for a reply. If true, H&P could probably be forced to close."
[ If H&P indeed didn't pay royalties for Unisys' GIF algorithm, they might not be forced to close per se, but if this is indeed true, and Unisys decides to sue, they might have to pay some serious fines. Also note that while this is not in unmoderated, it's highly speculative, unconfirmed and generally should be taken with the usual grain of salt - CK ]

You might want to consider that I would not post this type of of allegation (which could constitute libel if untrue) without covering my ass.

Certainly not. Say a publisher doesn't pay royalties or neglects to advertise and market properly.
What to do then?
Only one solution: sue them.
Stay tuned.

Hell, if it were to happen to Hyperion and I knew I had a good case, I would sue.
If I were an outsider, I would give a company the benefit of the doubt except in clearly manifest cases such as Phase 5 and the pre-order money theft.
This was documented by their public sollication of paid pre-orders and a public statement by the bankruptcy receiver which stated that no escrow account was found.
By extension also MorphOS needs to be given the benefit of the doubt if I were an outsider not in possession of all the facts.
I just note David that YOU decided that H&P should NOT get the benefit of the doubt and decided to cancel your order for Freespace (which BTW affects Hyperion more than H&P).
Whilst in the case of former Phase 5 managers/partners who ripped off their customers as a matter of public record, you don't seem to suffer from any such reservations.
You still did not explain that to my satisfaction. |
