Amigo follows up on serious allegations about H&P and says: "I also just asked Unisys as it says here, and am waiting for a reply. If true, H&P could probably be forced to close."
[ If H&P indeed didn't pay royalties for Unisys' GIF algorithm, they might not be forced to close per se, but if this is indeed true, and Unisys decides to sue, they might have to pay some serious fines. Also note that while this is not in unmoderated, it's highly speculative, unconfirmed and generally should be taken with the usual grain of salt - CK ]

Serious allegations about H&P : Comment 73 of 164 | ANN.lu |
Posted by Anonymous on 09-Nov-2001 13:55 GMT | In reply to Comment 44 (janne): "AmiTCP is based on a (what's now called) Open source (well BSD?)
TCP/IP Stack, who say's he who orginally made AmiTCP that he had
the right to close-source it again?"
AmiTCP is based on BSD, but that licence explicitely states that
you can use BSD software in "closed source" software. So yes, the
author of AmiTCP is allowed to licence his software any way he
likes, providing that notice is given that BSD code was used.
"have the orginal author of AmiTCP actually expressed any
interest in developing it further?"
What's that got to do with anything? If he claims that his
licence has been violated than that is sufficient. Do note that a
violation of a software licence is by definition, piracy.
"why hasn't he sued H&P then, cuuld it be because he doesn't have
a case?"
H&P claimed that they acted in good faith. The AmiTCP team took
this at face value and tried to come to an arrangement with
H&P... That was the last I heard of it and I assumed that a deal
had been reached, but with the claims made by Gerber in this
thread, I'm inclined to think otherwise. |
