Amigo follows up on serious allegations about H&P and says: "I also just asked Unisys as it says here, and am waiting for a reply. If true, H&P could probably be forced to close."
[ If H&P indeed didn't pay royalties for Unisys' GIF algorithm, they might not be forced to close per se, but if this is indeed true, and Unisys decides to sue, they might have to pay some serious fines. Also note that while this is not in unmoderated, it's highly speculative, unconfirmed and generally should be taken with the usual grain of salt - CK ]

Serious allegations about H&P : Comment 94 of 164 | ANN.lu |
Posted by Stefan Burstrom on 09-Nov-2001 21:13 GMT | In reply to Comment 92 (Ben Hermans/Hyperion): Sorry for this post, but I just had to put my 2 cents into this:
You say
> In no event can the sublicensee become liable for these payments because
> they have no direct contractual link with the original licensors.
>
> I hope this is finally clear.
If all that is said here is true and that H&P has acknowledged that their licence
from Active is not valid any longer, they have no rights what so ever distributing
software they once thought they had a valid licence for.
A question for you Ben, do you think it is right by H&P to _continue_ distributing
AmiTCP even after this discussion??? Imho it is quite clear that the owners of
the AmiTCP copyrtight does not think so and this would be enough for any court
to order H&P to stop their distribution until the case is settled.
*** Change of topic ***
*** Note that this has no reflection of reality and is merely a conspirathy ***
*** theory some might think amusing and some might be upset about depending ***
*** on their legal status ***
One might wonder why you Ben is so actively defending H&P. Defending their actions
up to todays date or at least the date where H&P acknowledged AmiTCP's rights is
perfectly ok, but trying to defend their actions not stoping their distribution
makes you wonder the following: Are there other software that are or will be
distributed by these people who so actively are defending these actions. Will I
see my software beeing distributed under some licence that I am not aware of?
It just makes you wonder...
best regards,
Stefan Burstrom |
