Is OpenWindow() or RemTask() covered by their IP?
Is the term startup-sequence or user-startup covered by their IP? In this case how could exist something like Wine (or it's commercial versions WineX or CodeWeaver's version) without Microsoft to sue them?
The fact is that you can clone an API, Microsoft sued Lindows for the name, not for the contents and BTW they lost. The only point where Amiga Inc. MAY sue the MorphOS crew it's the fact they could have seen restricted closed sourced code and I think that also in that case it would be quite difficult to win given the facts that large parts of OS where already pubblically available through various books. |
