You have 90 days to register a copyright, but only if you plan to register it. You don't have to register it at all, and the copyright is granted automatically at time of conception.
This is the United States, btw, so I am not commenting on another countries law, and I am especially not commenting on the law of outer-fruitopia...or wherever you probably live.
Anyway, Mr. Kevin Hisel, who I don't know at all, is obviously in the right here...it never gets more obvious in disputes of this nature.
Wayne claiming, that AFTER the fact, that some crony now claims he got the photo's on a zip disk....what nonsense, and you know what, Mr.Hisel claims he developed the photo's and then scanned them in...well if he has the negatives or even the original's which are of higher quality than the digital copies....
that ends it all, PROOF positive he is the copyright owner. That's all thats needed...remember this is civil law, not criminal, you can go into theories about faking photographs and gloves not fitting all you want.
now how in the world is Kevin supposed to prove in a posting to ANN.LU that he has proof....or to Wayne for that matter in an e-mail???
There is no way at all, in the long run, the only way he can prove himself is in court, but he had no need to go to court, because he got the pictures removed...its up to Wayne to go to court, if he wants, and thats just the law, and if he doesn't like it, he can write his senator. |
