Bill, this has no bearing on the case. This dismissal has merely to do with a motion filed by Thendic requesting sanctions on McEwan's behavior in regards to deposition process (his mystery health problems, delay's and flippant attitude during the deposition). The judge felt sanctions weren't warranted, although he put it on the record his disapproval of McEwan's behavior.
