11/12/2003 REQUEST by Defendant Amiga Inc for a delay in any decisions. (RS, ) (Entered: 11/18/2003)
Bill McEwen requests delay in the Thendic-Amiga trial (by personal letter on Amiga stationary with the Ravensdale PO Box address) - pro se.
We are in the process of locating new council (sic) for Amiga as well as finishing up our investment round so that we will be able to move foward with proper representation.
While I fully expect Amiga will have the funding and council (sic)
located before the requested extension......

Posted by acg on 21-Nov-2003 19:07 GMT | One thing that has been interesting, is that the Judge has accepted Mr. McEwens
representation that he(B.McEwen) is the CEO of Amiga, Inc.
Not that it matters much, but I do remember that it was being bandied about that
Amiga had changed CEO's recently....so that must have been a falsehood.
Was it BB who represented that he had information that BW was no longer CEO
at Amiga, Inc.?
The request for delay may be a stalling tactic also. However from some of the
posts here I gather that Thendic might be suing Amiga because Thendic wanted Amiga to port AmigaDE to its products (Products from Thendic which don't exist?)
Is it true there are products from Thendic which don't exist that were mentioned in the suit? If so, how could they sue. It would be like suing your car mechanic for not fixing your car (which you never brought to the shop).....No?
If the above paragraph is correct, maybe the judge will see through the ruse.
In jurisprudence( I use the word loosely)...sometimes an offender is given time to make restitution (like some stockbroker)...because they can make more money
while in the market (then in a prison)....
I wonder if the judge would call the suit a draw, put a restraining order on
Thendic's lawsuits, and force Amiga to get those T-shirts out...(let's face it guys--two or three days of lawyers fees could pay for those)...and wait for AmigaOS to roll out, and if amigaOS4 is a flop, well then that would be the end of Amiga, Inc., and the main debtors would end up being paid from what could be sold...Actually, I would guess that some of the people owed the least amount of money would get very little settlement. They could make more money being a day laborer, or panhandler, or a begger. |
