Very good points. Let's see:
IF Amiga Inc has to buy back "AmigaOS4.x" then it indicates that Amiga Inc doesn't own "AmigaOS 4.x", thus no AmigaOS4.x source code will be given.
Following Buck logic (fuzzy logic? :), he has previous rights over any AmigaDE update or development, I mean previous to Amiga/Hyperion agreement, so this was done illegally, and it's up to Amiga to solve this issue with Hyperion: pay them for the work as contractor/don't pay and go to courts/whatever..., but any Amiga development remotely related to AmigaDE cannot be dissociated from it, thus he has the right to access the sources, according to his particular agreement interpretation. I want to remark that this would have to happen following Buck logic.
I don't think Amiga Inc has the source code for Tao's core is one example.
Of course, it is not Amiga IP, so it cannot be included in Amiga/Thendic agreement.
Has Amiga Inc bought back AmigaOS 3.5/3.9?

Only IF Amiga Inc has the power to do so; for example, Amiga Inc doesn't have access to AmigaOS 3.9 source code thus forcing Hyperion to do a deal directly with authors of AmigaOS 3.9’s modules, thus bypassing H&P.
True, but valid only for external, contributed modules. As I was saying to Don COx, it all depends on the terms of the agreement. As it seems, all core code, upgraded from v3.1 to v3.5/v3.9 cannot be used, that's why Hyperion has have to re-update from v3.1 again -if you think about it, it's a HUGE work: go back two revisions, I don't remember how many years back, and not only recreate all the work, but making a step ahead, since they cannot only leave it at the same level than v3.9, and in addition porting it to PPC. Really HUGE work.
