Amiga Inc. has returned to the court, backed up with legal representation, new evidence and testimonies. With these resources, the defendant Amiga Inc. has managed to come up with a response to plaintiff's motion to modify order granting specific performance, no less than six declarations, and a certificate of service.
The names of those who have filed a declaration are:
Barrie J. Moss AKA "Fleecy" (Amiga Inc.), Evert Carton (Hyperion), Garry Hare (KMOS), Ray A. Akey (Amiga Inc.) and Bill McEwen (Amiga Inc.).
Furthermore, Ray A. Akey filed 11 new exhibits (exhibit A-J) along with his declaration, which are recurringly refered to throughout these new case filings.

Amiga vs Thendic Update: Amiga is Back! : Comment 128 of 129 | ANN.lu |
Posted by Gregg on 19-Mar-2004 14:54 GMT | In reply to Comment 127 (Ketzer): Bad wording, sorry. You're right that actual proof of receiving mail/packets at that address in the time the offices have been vacant has been said to exist, but not actually presented.
Phew! That was close - glad we caught it, eh?
Anyhow, this is only "optional"; proof that the packet has indeed failed to be delivered is needed (and for what reason). If you send a largish packet to anyone, especially if its part of your end of a contract, i'd expect you to keep the corresponding forms (or whatever).
I agree; personally, I have my doubts about whether Buck actually sent anything to McEwen by mail, but the whole thing is so farcical that little questions like that seem almost irrelevant.
Anyway, considering the behaviour of the usual clowns around here, it wouldn't make any difference if Buck _had_ produced evidence of delivery. Let's try out some "explanations" :
"That's not McEwen's signature! Somebody was lurking outside AInc.'s evicted offices and intercepted the package. Probably the pizza delivery boy that Buck paid somebody to send! Yeah, that's it!"
"That's a receipt for a different address! Buck photoshopped the receipt! It's all so obvious - just look at this pixel here!"
"It's not true because McEwen said "I'm sorry, I was running on a treadmill in Montana at the time." - see?"
Farcical? Yup. Far-fetched? Indeed. Likely? Unfortunately, all too; just look at all the silly theories people (including yourself) are spouting about Garry Hare's "AInc. CEO" business card.
