Amiga Inc. has returned to the court, backed up with legal representation, new evidence and testimonies. With these resources, the defendant Amiga Inc. has managed to come up with a response to plaintiff's motion to modify order granting specific performance, no less than six declarations, and a certificate of service.
The names of those who have filed a declaration are:
Barrie J. Moss AKA "Fleecy" (Amiga Inc.), Evert Carton (Hyperion), Garry Hare (KMOS), Ray A. Akey (Amiga Inc.) and Bill McEwen (Amiga Inc.).
Furthermore, Ray A. Akey filed 11 new exhibits (exhibit A-J) along with his declaration, which are recurringly refered to throughout these new case filings.

Amiga vs Thendic Update: Amiga is Back! : Comment 42 of 129 | ANN.lu |
Posted by Gabriele Favrin on 16-Mar-2004 11:38 GMT | In reply to Comment 20 (Eva): The pathetic ppl outhere that hope in AMigaInc must understand a word: RESPECT.
Don't worry Eva,
most of the people who commnts these events do not know
anything about legal actions and how they work.
The judgements against Amiga Inc (which still owes a lot of
money to a lot of people) are there, Amiga can fill whatever
they want (not that anything signed by McEwen, Key, or Moss
can be taken so seriously by the judge) but this does not
mean they have won anything.
On the other side, once again Amiga Inc kicked his fans.
They don't care at all about desktop. It was just a way to
try to collect money. Now they sell all the mess to another
company and concentrate on /dev/null (ie. the digital
market, where their competitors -eg Nokia with SymbianOS-
have just a little advantage over them :))
The die hard amiga fans are very happy, showing
once again that they do not know how real world works.
I just read a poor kid trolling an "revengeeee revengeeee
:)))" on an italian forum. Poor guy, he doesn't know that
this is not a judgement. They try to hide the truth, ie.
that once again Amiga showed what are their goals and that
the so called 'amiga community' is not part of them.
Also there is an interesting point to note: I've read many
classic users or ex Amiga users who are sure that in some way
(legal or not) OS4 will run on pegasos and
in that case they'll buy it to use OS4. So, if this is
what the Amiga community wants, be sure that it will happen,
no matter who will win (and again, don't forget that Amiga
didn't win yet, they just filled an appeal).
Also, I'm really glad about the sell (if it's real and not a
trick) because McEwen and company did so much damages to
Amiga community (which is based on the classic OS, not on
the digital fantasies). that they do not have to mess
anymore with OUR os.
Let's see what will happen and don't worry, Eva...
;-)
>They lied from 2001 to today about their competitors.
Don't repeat yourself over and over. Even the judge knows
this. :)
>They continue to publicize a non finished OS ... while they
>sell it to an unknow company just because they are unable to
Promote, not publicize :)
>It will be really fun now the answer of all investors of
>AmigaInc when they wil see that for 4 bunch and a opiece of
People invested in them for the DE promises.
OS4 is not related to Amiga. It has ben created by Hyperion,
while BuggyOne has been created by Eyetech using MAI
hardware. Thre fact that Amiga sold it (again, if true) is a
good news, because thay didn't have anything to do with
AmigaOS and they didn't deserve to use it or earn from it.
>And here there are ppl that continue to support this
>company ...
Die hard fans, who mainly post from PC because they:
don't have money to buy A1; don't want to buy it; are
waiting for the next version and so :) |
