Where's KMOS? How come they arn't coming forward and speaking to us? It's been a year and they've said nothing. Why is Amiga Inc doing all the talking like "KMOS will honor all contracts" for them, why doesn't KMOS say this themselves? it doesn't matter what Amiga Inc say, as they don't own the OS anymore, I want to hear from the horses mouth!

Yes, after having read the license in a little more detail, I agree - it was Thendic Electric Components, GmbH (a German company). I also notice it specifically defines "Thendic Products" as "... all devices developed, manufactured, or ***sold*** by Thendic..."

I have to admit I am ignorant of all the legal stuff but I noticed the following in the license:
4.2.1 Amiga hereby grants Thendic a worldwide, nontransferable right and license to: (a) embed, bundle or otherwise incorporate the Amiga DE Software in any Thendic Product subject to this agreement; and (b) use, market, perform, display, reproduce, license and distribute (directly or indirectly through Resellers and in all media now known or hereafter developed, including, without limitation, by electronic transmission) the Licensed Software as embedded in and/or bundled or otherwise incorporated with any Thendic Product.
Agreed, Thendic Germany has the license. However, considering the above indicates the rights and license are nontransferable I don't understand how this has any relavence to Genesi products whether Genesi was added as a plaintiff or not, especially considering Genesi is a merger between Thendic-France (which other posts seem to indicate failed to happen) and bPlan.
Is there a formal relationship between Thendic Germany and Genesi beyond them being owned by the same people? Surely one would have to own the other or Genesi's claim is worthless? |
