Posted by gary_c on 13-Jul-2004 00:23 GMT | In reply to Comment 19 (Graham_NLI): The last thing I know of is that the judge required Amiga, Inc. to provide the AmigaDE port to the Pegasos (or to provide Genesi with sufficient information for them to port it themselves -- I've heard this possibility mentioned but don't know if it's valid). Genesi's request to expand the scope of the decision to include AmigaOS was rejected even before Garry Hare and friends filed their 11th-hour statements as described in his interview. I'm not sure what the mechanism is now to compel Amiga, Inc. to comply with the court's decision; as far as I know, nothing new has been submitted to the court that would change anything, so apparently the situation remains that Amiga, Inc. must provide the port. If anyone is aware of something new filed by Amiga, Inc. or KMOS, please give us details.
Genesi doesn't seem to be interested in further litigation against Amiga, Inc. in spite of what might be opportunities created by apparent untrue statements in depositions by Bill McEwen and implicitly by others assocated with Amiga, Inc. during the summer of 2003 regarding ownership of the Amiga IP, which it was revealed had already been sold.
I imagine it's now clear that there's nothing further to be gained by legal action, or at least Genesi's time and resources would be better spent elsewhere. My own opinion is that whatever value the Amiga brand and IP might have had has steadily dissipated over the many months to the point that it now of negligible value. The Pegasos is making more progress in markets where a clean break from the past is worth more than an association with Amiga, and fans who are aware of the origins of the Pegasos and MorphOS don't need the label for authentication.
