I'm a bit surprised this wasn't mentioned and discussed anywhere else: Before anyone else asks , yes the contract was signed. Alan explained that the contract gave Eyetech, Hyperion, H+P etc the right to develop os4.0. Amiga Inc will then take control of the OS back for a 'consideration'. (Taken from the World of Amiga Souteast show thread.)

how could the contract be signed when the devlopers (hyperion/h&p) were not
present.
if they signed it before hand then it is another matter.
Are one got any details or the actual show itself..?
news has been scant
did the q&a with fleecy occur as stated?

(I wonder what the "MorphOS camp" come up with now to twist this is another "AmigaOS4.0 won't see the daylight, buy MorphOS" propaganda)

of this tactic. Those that it is going to work on it has worked on already. I am seriously concerned that they will see a severe backlash and I dont think that the project deserves it.

"Consideration" is a legal term used in the contract law of common law countries such as the UK and the US.
It refers to the benefit (money, action, transfer of property etc.) one contractual party can hope to receive from the other.

Ben,
As no one really believes in coorperation between you and the MorphOS guys anymore, isn't it possible that you work "togheter" with the AROS team to get atleast a compatible API ??? This would mean that the software developer hass less work and a greater marked in the future.
The AROS-team already invited other parties.

Berend.

I don´t know exactly what you are referring to, but...
Yes, you are right - since the owning company was always either unable or unwilling to spend significant amounts on marketing, that was left to the users showing their systems to other users.
That´s why I found that DE / HW independant OS 5 idea so intriguing.
And that´s why I found the PPC OS 4 and AmigaOne idea so stupid...

It seems to me that several AInc.-biased people here happily blab about
"MorphOS propaganda", while the imaginary statements they refer to
(without specifying the source, of course) are nothing but statements in
which those that made them firmly believe.
This is inappropriate.
Also I bet some imaginary bucks that most people, if not all of them, that
use this "propaganda" phrase, can't prove those statements they refer to
to be wrong.

Maybe they have the rights but nothing says:
- the project manager is ....
- the project is split in smaller parts: 3D, Wb,...
- each part is being worked on by ...
- the (approximative) timeline is ...
- there will be internal IRC session each ...
- OS4.0 will support ... hardware
- the community will be able to give their ideas, so that they work for the OS too.
- people that would like to help should contact ...
All these things should be done now... It really seems that NOBODY knows how to manage a project :(

I haven't commented on it because I find it incomprehensible. Ok I
understand that it was about certain parties being given the "right"
to develop 4.0. Well you don't need a "right" to develop something..
they might want the sources, they might need the right to sell it..
but this statement doesn't make much sense.
Then, "Amiga Inc will then take control of the OS back for a
'consideration'" which is even more impossible to understand. Ben
Hermans probably explained why the word "consideration" is in there,
but the sentence still doesn't make any sense whatsoever. I'm waiting
until Cologne to see what it's actually all about.

Yeah, I agree.
More users are needed that are willing to show off there system. I have quite a bit of funny showing my system off to Windoze users, here on the OSU campus. So far I think I've manage to impress them all. Scalos, Birdie, and a few others work nicely for impressing ppl. Being able to simple run multiple monitors is also nice. I've think I've even managed to impress a few comp sci ppl with the system specks, but then agian the specs for my system can take a few minutes to list.
The Amiga is a machine that is great for impressing ppl with, especially with PPC.
What I think the Amiga really needs is more advertisement. More ppl need to about the existence of the machine and OS. I personally am getting tired of being asked what version of Windoze my Amiga is running.

You might not need a right to "develop" something but you sure as hell need a right to sell and distribute something when you are using somebody else's source-code and intellectual property.
The OS 4 agreement is rather convoluted but suffice it to say that OS 4 will happen and is in good hands.
Many OS 3.5 and 3.9 developers have already signed on for work on OS 4.
People complaining about project management etc. have no idea about what is going on behind the scenes.
I would invite these people to attend the Cologne show or reserve judgement until that date.
Which is probably too much to ask for.

True. Then why is H&P continuing to sell the following packages:
- Amiga"OS" 3.9
- Amiga"OS" XL
Which contain copyrighted material (AmiTCP) owned by NSDi ?

The HW supported has been communicated many times. more drivers can be written by third parties when the OS is ready. This is not Microsoft, it takes a huge amount of money (and market powet) to be able to convince companies to write drivers for you.

"Wait": the word the most said in the Amiga history...
When you are late, there's no point waiting.
The thing that you don't realise is that a final OS4 should be at Cologne not only a demo. Why ?
Because since "Amiga has put OS4 development back in house", 7 months passed (seven !).
Don't tell me seven months are not enough to do that job (here I'm not blaming you, ok ?)...
We'll see at Cologne...

Using the word allegedly is sufficient in the UK to bypass most if not all libel laws, indicating the allegation has been made it is yet to be proven true or false. You dont even need to say WHO made the allegation.
AFAIK he might be completely correct or he might be incorrect. It doesnt change my point of view at all - MorphOS is an interesting project but like AmigaOS4.0 has yet to make it to a GA.

Actually, that is not strictly true - methinks you have been watching "Have I Got News For You" too much!
Even throwing in the word "aledgedly" is not enough in some circumstances.
For example, if you tell complete and very damaging lies designed to cause damage, you can use "alledgedly" to your heart's content, it won't protect you from libel.
Just ask Private Eye magazine, for example.

LOL!
OK so the law in the UK is WAY too convoluted :)). In most cases if you CAN cite a source you can get away with it ( the litigation passing to the source ) but the scandal-rags and newspapers tend to want to "protect" their "sources" which can (a) put them in contempt and (b) make them liable to prosecution as the "source". There are caveats protecting the transmission media of the accusation ( so, say BT couldnt be prosecuted for you making an allegation that a third party overhears ) but then offsetting that you have editorial responsibility and journalistic creativity.
I used to understand libel law quite well. A LONG time ago.
I wouldnt cite the Private Eye case as a gospel interpretation of the law. Christian couldnt get sued for example.
Allegedly certainly weakens libel cases sufficiently and nearly in totality if you can cite a source which is why I guess the TV program you refer to uses it.
