The swedish Amigamagazine Azine has made a Q&A with Hans-Joerg Frieden (Hyperion) about their Quake2 port availiable online. You can read it here. The Q&A was originally published in Azine #2.

Mods can't be under GPL by definition.
They are governed by the Quake 2 EULA from ID Software.
Which is also the reason why we can't distribute the Quake 2 port with the mods on the same CD.
The ID EULA only allows distribution from end-user to end-user directly (ie not via dealers).
ID Software was quite insistent that we drop the mods from the main CD.

If you wanna see it in action, check the messe-video btw. I had it running on my machine (a Pegasos, sorry Ben :-/ ) and it attracted quite some attention and enthousiasm! Great work!

(It made me wonder when I recieved a 3rd CD with the mods as I was told they would be on the Amiga-bin CD by Hans-Joerg)

The Mods are on the Mods CD which you either get from the dealer or you can
request from Hyperion Entertainment, if the dealer did not include a Mod CD (free CD, available as long as stock lasts, only 1 CD per Quake 2 Amiga Buyer). They're just not on the same CD like the Quake 2 Amiga Executable.
There is an installer script included to make installing the Mods easy.

I confess to not having bought the game yet (I'll be getting it as soon as I receive OS4 as part of my Earlybird purchase), but if the mods CD is supposed to be free-as-in-beer, why not put the ISO in your web site and let dealers and broadband users get it themselves? (you could walk into your local Amiga shop with a blank CD and walk out with a mod CD). Is there some legal reason why you can't do this?

This is the CD which you'd already mastered, and could under no circumstances change right, Ben ? Which was why you couldn't include the Quake 2 source code, right? The source code which would easily fit onto CD2 and which you in fact explicitly chose not to include in order to run roughshod over user's rights [see also ongoing problems with Aminet]
See previous ANN article where Ben lies, then lies again, then after being shown to have lied claims it was a "misunderstanding" (that's right, Mr Hermans is a lawyer but he can't understand a clear and explicit license agreement until it is explained by ANN readers) and makes up a new and even bigger lie which he has now all but admitted to in this "correction".

We're complying fully with the GPL license and explicitly reaffirmed by the FSF.
Anybody who wants to obtain the source-code CD (which contains the Quake 2 source-code as well as the source-code of numerous mods) can do so.
Some have actually already done so since quite some time.
The EULA issue regarding the mods is completely unrelated to the GPL issue and incidentally, no Quake 2 CD was ever shipped to an CD user with the mods on it.
So no "remastering" took place.
