Exactly my point: everyone whines 'cause MS is at the top of the chart, and instead of making themselves more competitive they try to put MS down... You can't legislate morality. Law and justice, when in proper form, have nothing to do with morality. The proper role for the US Federal courts in this case is to make sure that protection of patent and property rights as chartered in the US Constitution are upheld. This article in the Register is missing every crucial fact needed in order to make this determination.
I find Sendo's decision to do business with Microsoft to be questionable in the first place.

Did you read the article in Reuters? The link to it was included in the Register's article... It says:
"The court filings allege that Microsoft, in search of new growth markets but lacking mobile phone expertise, extracted crucial information about the industry from Sendo and passed it on to friendly low-cost contract manufacturers in Asia."
This attitude is fully sueable, given you have signed a NDA agreement, as it seem to be the case.

Before you make such claims Fabio, I would really suggest you read the "findings of fact" in the MS versus DoJ case.
You'll find that the antics that MS has been up to these past 15 years are simply beyond belief.
I know it's popular in some republican circles in the States to claim that government should not interfer and that other companies are just going after MS because they are successful.
Fact of the matter is that MS engaged in all kinds of illegal anti-competitive practises and that they were (despite their extremely deep pockets and the ridiculous American legal system which favors the guy with the deeper pcokets) repeatedly convincted for all kinds of breaches.

Microsoft did the very same thing to GO Inc. who developed a predecessor to Microsoft's "new" tablet PC about ten years ago. Both parties had signed non-disclosure agreements, but Microsoft obviously didn't take this very serious. In fact, Microsoft send a couple of employees to GO Inc. for no other purpose but to fully analyze their technology. Once Microsoft had the information they wanted, all comunication with GO Inc. was stopped...
Just a few years later, GO Inc. was no more.

DE/AACE was going to run hosted on the previous WinCEy version, so it's not a big deal. IIRC, Elate's already available for Symbian/StrongARM, just not out in consumerland...
However, for whatever reasons, Sendo was looking at Insignia's solution as a replacement for the Elate/Amiga bag... http://industry.java.sun.com/javanews/stories/story2/0,1072,47755,00.html ...perhaps because it was feeling like the VM-of-choice among the MS camp, but then, Insignia has some connections to Symbian as well... Very well put. As a "Resident Alien" living in the USA I have to admit that the legal system here sucks as far as justice of the "little man" goes. I have friends in law enforcement too and they'll tell you the same thing.
There's something very said when you can catch a criminal in the act, have video footage, fingerprints, a "smoking gun" and a signed confession only to have the whole thing thrown out of court for a minor technicality. Most of the time the criminal is back on the street before the arrest paperwork is complete. I was actually dumb enough to pay the first two speeding fines I got over here before I realised that by contacting the "right people" you could have them "disappear"...
Of course, the UK system isn't THAT much better, but if the Founding Fathers realised just how much the Constitution is being abused by the lawyers then they'd be spinning in their graves.

Fabio, I think this is another case of things seldom being as simple as they might appear.
First, MS has been clearly identified as a monopolist; different rules apply to monopolists.
Secondly, MS has a long-standing agreement with Sun to implement and support Java; Sun just wants them to support the Java standard, not MS's just-a-little-incompatible implementation of Java.
I'm sure you can work out why MS's Java is different, and why Sun (and pretty much everybody else) thinks that standards are standards, and are happy to see this concept enforced.
Finally, don't for a moment think that Sun are the only people who can make money off Java; it is a standard that everybody can benefit from - and that's MS's peeve, since "everybody" is the enemy to their way of thinking.

Despite what you may think, arbitration helps quite a bit. Our country has become lawsuit happy because of our victim society mentality. Low men on the totem pole look up and figure if they screech and screech enough, they'll get the big bad old top guys to give them some money to shut up. It's well past time that ended. I'm not talking about legitimate suits - faulty manufacturing of critical auto components, suits over workplace saftey etc.
But ridiculous "Mcdonald's Coffee" lawsuits and the very idea that somehow large companies (e.g., Microsoft) should be made "more equal" are totally stupid.
I could point up flaw after flaw with other legal systems around the world, but y'know what? I don't live in Denmark, Togo, the Phillipines, Russia, New Zealand, Japan, Brazil, Canada, nor anywhere else. I can't effect a change there. The business of the citizens of those countries is just that: their business. Not mine.
I'd prefer it if Hermans et.al. spent their time writing the goddamn next generation Amiga operating system but apparently that's too much to ask, what with all their time being eaten up making biting legal analysis of the United States - not to mention their overall social commentary.
Have fun running Linux on your broken MAI boards, lads. It's all you're getting THIS year. ("THIS year" meaning the next twelve month period - didn't want to imply that either jack or shit were forthcoming from Hyperion).
Postscript: if anyone thinks I'm some kind of Morph OS fan, guess again. Bill Buck et.al. are as crooked as a dog's back leg and I wouldn't touch a Pegasos motherboard with a ten meter logic probe as they're totally inadequate in terms of expansions, do *NOT* run an Amiga OS, and ultimately look like a PcChips celeron motherboard I threw away some months ago...

Sure, there is indeed problems with our (USAs) law suit happy attorney's over populating the civil justice system. I have never heard of any civil justice system that didn't have problems. Ben has now repeatedly slurred the USA in some fashion, be it the "illiterate" theme he was on, or now the USA's justice system.
Perhaps I'm reading too much into this. I'm just getting tired of Euro-Trash thinking their are morally and intellectually superior even though the idea of getting their hands dirty is revolting to them. I certainly hope Ben doesn't fall into this catagory.

We just had to let 4 alleged terrorists go because our equivalent of MI5 should according to the judge be seen as an agency providing 'tips' to the police and then the police should start their own investigation.
In other words, what the spies come up with doesn't hold up in court because is has no legal grounds... The police should redo everything and come up with the same results so that it then would be considered legal evidence.
Ofcourse about 10 more alleged terrorists are now jumping up-and-down to get released for the same reasons...

Microsoft were not found to be a monopoly. Furthermore, even if the justice system HAD found them to be a monopoly does not mean that they are a monopoly. In fact the ONLY monopolies that have ever existed the US have been created by the government ie. the former Bell/AT&T. In fact the origin of the anti-trust laws are the result of a political vendetta. Also, note the use of the word "trust." It does not mean monopoly. Microsoft has been characterized as "anti-competetive" yet their success is due to their superior ability to compete. They are very competetive. The ethics of their business practices is indeed questionable. Yet, so long as they are held liable to any breach of contract I do not see a problem.
