Has anybody received his coupon yet? I'm still waiting for it (and my T-Shirt, too!!!) and now there is not even an address at Amiga Inc. that I could send my complaint to. Also my emails are left unanswered. Isn't their behaviour criminal? I mean: I have ordered a product and not received it yet - more than a year after placing my order .. anybody here can evaluate the chances of a law suit against them?

I'm in the same situation.
I thought about legal action but for the sake of $50 its not worth it. Maybe we can all club together and get Ben Hermans to represent us in a group action? Seriously. He is a lawyer and is best qualified since he knows all the ins and outs of this situation.

And, regarding the coupon, there is none. And even if there was one it would be worthless, since no retailer would redeem it (at least none of the ones I asked) - I guess Amiga retailers trust AInc about as much as the rest of us (ie. not at all). Eyetech said that when I buy an AmigaOne I probably have to send the reciept to Amiga Inc (which could prove rather difficult considering they don't have an address...) and then Amiga Inc refund the $50. Yeah right...

I forgot to mention about the T-Shirts...

At the start of January AInc apologised for the delay in sending out the T-Shirts and said it would be sorted out in a "few weeks" (we all know what those words mean in Amiga terms...) Well, its March now!

However, during all this time we've been waiting if you wanted an Amiga T-Shirt you can go to mall.amiga.com and buy one right now! Why don't they send us one of those shirts??

Those damn incompetent liars at AInc are a disgrace to the Amiga name. Their supporters are becoming more thin on the ground each day that goes by.

Unfortunately it was exactly this reason why I didn't go for the $50 coupon and a T-Shirt. I just don't believe a word Amiga Inc. says anymore. If they can't even deliver a bunch of T-Shirts it doesn't say much for our future.

Is anybody here on a developer or support network with Amiga Inc? Surely someone with email contact to Amiiga Inc. can perhaps ask the question and press home the issue.

Otherwise everyone is left thinking that Amiga Inc. is unable to afford even a thousand T-Shirts. After being paid $50 for each one it would be logical to deduce that A Inc. have therefore spent the money already and there's nothing left to produce the goods. This does not bode well.

you have your Amiga1

email fleecy@amiga.com with a scan of your receipt or any proof that your amiga1 has arrived and has been paid for.

Tell him you want the $50 and T-shirt is seven working days. Point out they have had the money since last july. Point out also you credit card interest rate and that they should pay your interest on the $50 over this period.
Finish with that you want you money, T-shirt within 7 days or you are going to your credit card company.
If you dont have it by then. Report them to your credit card company. Who will credit the money back to you and will pursue amiga for it themselves.

As soon as my Amiga1 XE turns up (Funny you have yours as hans-joerg still has finished the final version of u-boot for the A1's, unless you have a dev XE not a end-user XE), then i will get my credit card company to pursue amiga for the money.

Personally, I would rather have Hyperion/Eyetech take over full control of all things Amiga Inc have. At least they can run a company, and you get some news from then on at least a regular basis. Both companies have always done an excellent job on the products they release, and I would rather support them, than A-Inc anymore. Perhaps it's me, or are the Europeans just good at running reputable companies that don't always want to rip you off???
I'm now starting to get fed up with A-Inc myself. We are doing this, that and the other and we'll let you know as soon as we can due to NDA's. This seems to be there excuse now for anything they have to say. If they are supposed to be producing something, then it's about time they either come up with the goods or shut up forever. I think we're all getting fed up about hearing about there Windoze PC Handheld products.
If A-Inc want to stay in business, then they better think quick. If everyone who bought a $50 coupon got together with there credit card companies, and threatened them with the possibility of wanting this money back, the Credit Card Companies can do this, and A-Inc better start paying attention.
I would love to see what happens. I say give it to the end of March and if there is no sign of anything coming from A-Inc, except the same of NDA's can't say anything speech, then we should proceed. If they've closed down, then we're stuffed anyway.

For those who used a credit card ..... the amount of time that has passed is probably beyond the 90 or so day you had to file a complaint with your CC bank.$50 isn't really much for them to consider pursuing as it'd cost them more than that to pursue it, unless any one bank can sum total all who paid thru that given bank. But still the amount to time that has passed is even beyond the outer limits of 120 days.As to the number of paying club members.... considering the means/media of advertising the coupon/club offer, I'd assume that most would have heard about it thru or near enough to the media of the internet to be able to look at such media for information and even to add their own comments.Now does the amount of comments you are seeing as representitive of the stated number as one would think?Perhaps the numbers were padded......As to the comment about Ben Hermans being a lawyer... On another thread there is comment about some investigation done by BBVR showing Ben to be a legal clerk, not a lawyer.Getting blood out of a turnip??? Perhaps not, but in a class action against Amiga it is perhaps possible to get what Amiga IP they have to be released to the community in such a manner that efforts like AROS, etc. will no longer have a potential weight of IP bitch slapping by Amiga hanging over their head.NOTE: AROS is under such a license that is non-constrained in such ways that both commercial and non-commercial interest can make productive use of it.Also note that the Amiga Patents held by Gateway are not effected by anything Amiga Inc does or not, so I suspect there still may be some IP bitchslap possibilities.In summary, perhaps the best route is a class action suite brought on by consumers and other purchasers of Amiga Inc products that did not meet up to expectations. It's easy to level this nonsense against someone or something when you don't know the situation. Fact is, if you were in our shoes, you'd have gone out of business long ago. The fact that we are still alive, still working and could do so for MUCH longer (if needed), is testament to Amiga's longevity and ability to stay alive even through rough times. This is something that none of the owners since the demise of Commodore can say.

Don't worry, Amiga Inc isn't going away anytime soon!

By the way, constant readers.. there are far more club members giving us kudos for sticking it out that there are those of the other opinion. Just like anything else, the dissenters (and non-members who really have nothing to gain but additional negativity) are a lot louder than the others. :)

Thought everybody knew that Amiga was in trouble at some point. Guess they have secured more funding since they are still with us.

Can't see the problem with the T-shirts.. It would cost them max. $4000 to honour but I guess whoever provided that funding also decides what it's used for (develpement not t-shirts)..?

But I would like to point out some things that should be obvious.

I'm going to buy some games from Centsible Software. They are in the US, I am in Canada. It will cost $14 to send it. A T-shirt would probably cost the same amount. That leaves $36. A shirt approx. $10 (doubtfully less than that). That leaves $26. Then, say a letter with a membership card, min. $1. It's a LIFETIME membership. Do you really think $50 could cover that? They make nothing ($$) and offered a $50 rebate as well. That one is resolved by raising the price by $50 dollars.

Do you think they would have spent $5 million (I couldn't find out how much they paid) on December 31, 1999 to purchase Amiga IP from Gateway2000, for a scheme to gain $50,000 2 and half years later? How much does it cost to run a company? Doesn't just 1 full time programmer earn at least $25,000 a year? I don't for a second believe they used the money to buy a Ferrari. What could they do? They couldn't ask for donations.

I have no problem not getting a T-shirt or a $50 rebate. I want AOS4.0!!!! If my $50 shortened the time by 1 hour * the amount of people that sent them some money, I would implore that people could see that as a necessary thing and accept it. No one else would have put up with the grief and harrasment to do this for us.

Amiga Inc. are not the bad guys. They have a shoestring budget, they are doing as much as they can. Sometimes you have to look past $$ and cents. Some people are compelled to write freeware. Expecting nothing in return. Producing an OS isn't a trivial task. The people behind it have to earn something. So few customers are involved, which causes us to bear a big price.

This is something that is, without any doubt WORTH IT.


Amiga! AOS4.0 = inexplicable tremendous value!

Well, that's more of a reflection of the community who sent the money than it is of anything Amiga inc is or isn't capable of doing. *ANY* company who collects money for undelivered product will profit, there's no mystery there.

1. take orders and prepayment for product.
2. ???
3. profit!!!

That's not a business plan that will last forever. What you're buying in time, you're paying for in bad PR and lost customer loyalty. I'd have to completely disagree that this is a "testament of longevity" as this is the very thing that works against success in the long run.

(sigh) only time will tell I guess.

Will it make you feel better that you may possibly harass someone into a medical condition that sends them to a hospital?

There's ALWAYS times when things don't work out for people; Amiga Inc. and the others involved are in such a state. It's not worth it to condem and abuse them in the ways some people choose to. Imagine 200+ people sending you e-mail saying they HATE you. How would YOU feel? THINK about it!!! DO YOU THINK THEY ARE CRIMINALS????

But Hyperion didn't see a single cent of that 60 grand coupon money. And hence yours and my $50 went nowhere towards the goal of a new PPC AmigaOS. Instead it went to paying AInc's phonebill/rent/whatever.

If you want OS4 so badly it would have been better to have sent the $50 straight to Hyperion. Amiga Inc talk (or at least, they used to), while Hyperion does the work.

So did a lot of companies - the original Amiga Corporation, for example! Having a shoestring budget doesnt mean you are permitted to rip people off, tell lies, make promises you have no intentions of keeping, and accomplish nothing. AInc treats us like mushrooms (keep us in the dark and feed us bullsh**). What is happening with CeBit, for example?? We had that big announcement about the relaunch of the Amiga desktop platform and then it turns out they haven't even booked a stand and don't say a word about it, like they're hoping we forgot what they said (like all those other big promises Bill made in all those other big announcements). I'm sick of it.

Now look at Genesi. They have vision, enthusiasm, commitment, and more importantly, a tangible product. They support users and developers, sponsor shows, keep us informed. Such a stark contrast to the way Amiga Inc conducts business.

Yes, Hyperion deserve a lot of respect for what they're doing, but again this has nothing to do with Amiga Inc.
