No, it looks like they were locked out of their offices and all material property seized to pay off their outstanding debt, which is what most people knew to be the case for a very long time.

This means all IP, company documents and personal property of company employees would be returned to them, but all equipment, such as furniture, computer equipment, printers, filing cabinets, even the infamous cubicle partitions would all go. One would expect any hard drives to be wiped clean, if only to cover the creditors from any threat of breaching copyright laws.

All this is just confirmation of what is already public knowledge. That some people tried to spin the event as having a different meaning is inevitable is suppose.

There is an awful lot of HD disks in the sale though, I wonder if they all went through DoD-quality erasing (I doubt it).

You hate to kick someone when their down I bet, I know I do. Most of the time you don't wish ill fate on anyone or any company. But their are exceptions and Amiga Inc is one of them. Bold face lying to people and telling them to trust you is bad. Taking people's money over false pretenses is very bad. Outright stealing is the worst. Amiga Inc has commited all of these offenses. How anyone, especially a coupon owner or party pack purchaser could be an apologist for Amiga inc is beyond me. They really are cultist!!!

You're kidding, right? That's one SMALL office suite, and a relatively tiny pile of equipment.

I don't know, but neither the creditors or the auctioneers are entitled to sell or give away Amiga Inc's IP AFAIK, and the same applies to any confidential documents or information that may be on that equipment. Not taking the appropriate measures would leave both open to a counter-suit, if not from Amiga themselves (since I doubt Amiga Inc can afford to sue anyone, even when they have a rock solid case), then from anyone who might acquire Amiga Inc's IP in the future. When you consider the possible fallout, I know *I* would wipe it all clean rather than take the risk. The relative cost of doing so is peanuts, specially for the tiny amount of equipment involved.

Anyway, even if they are careless, what does it matter to us? Anyone who acquires the systems and finds any IP, sources, etc. on them still won't have the rights to any of it, so what's the point? That's assuming that anyone thinks those machines ever contained anything of value anyway.

Actually most of the quotes say they are selling of stuff they don't *USE* any more. Since they've been deprived of access to any of that equipment for some time, this is technically true.

It's a subtle but significant use of words and meaning spotted by all those who read with their eyes open. :-P

Yep, it's like saying "a significant amount of xxx has been sold to yyy" whenever you sell one or two units. It really looks a lot better if you just glance at the news instead of get the real numbers. But of course, only a few people ever know the _real_ numbers. If you ever see a press release of someone saying they have sold "a signicant amount" of anything, read it as one or two units ;-)

It's not lying, it's making sure you don't go out and say "we suck, and we know it" :-)

I pity whomever buys the HP Vectra systems. utter, utter junk. I can't say enough bad about them. Let's just say that whomever designed them was also probably responsible for the design of Packard Bell computers. They're THAT BAD.

I wish I could get my hands on the network gear, though. I could use a few routers and hubs, plus a Cisco box to practice on. Ah well.

As a (loosely relevant) point of reference --- a couple of years, Australia's second airline (Ansett) went tits up. And about 9 months or so ago I bought a used SGI Indy at an auction place like the one running the Amiga auction --- with all the software still on the hard drive. It was quite evident that nobody had made any attempt to wipe any data.And while I haven't been to the auctions in a few months, I'd estimate a 500MHz Celeron to go for about US$ 50-100. Hooking the machine up to power and a monitor, and wiping the hard drive, takes a lot of time, and thus money. And the landlord probably couldn't care less about AI's IP, but *does* care about getting as much money back as possible.So I certainly wouldn't count on hard disks being wiped.

True Bill, but few can say this definatively BEFORE it's proven, even
if some silently suspect it, and thats the problem, not everyone is going to

Anyway, I do disagree on one subjective point, this is not the office furniture
of a lean and mean operating machine. This is dot-com excess. If they had
30 people sitting in front of PC's, dagnabit they should have produced something.

They always said they did small contracts with key people worldwide...that plan made sense to me....now it appears they were spending money like a drunken sailor on shore leave :-) <--playing *subtle* word games of my own.

Absolutely right. This is the crazy optimism of the dot com era. "We borrowed loadsa money from a VC, and when that is all spent we can easily borrow some more, and when that is all spent we will have an IPO."

However, I think the people concerned may have learned a few things in the past couple of years.

(no longer responding to same message) If having a computer, a larger than 15" monitor, and a nice padded chair is excessive spending of the venture capital, then you're a true Spartan. It's really IMO the minimum necessary to have a decent ergonomic working environment. Worldwide conference calls, ditto for a good speakerphone and some video switching. Running a modern computer-related company, with a corporate website? I'd say that called for a router, some switches, etc. More than five people commuting into the office? Put in a refrigerator. None of what I saw looked like serious excess.

It's not only the IP but the regular documents in an office (records, license agreement drafts, personal e-mails, t-shirt waiting list, whatever). Any of this stuff coming out could be really emberassing. And aren't there pending lawsuits ? How can the records possibly be erased/sold under such circumstances ?

It was not the items themselves, but the quantity of them.
You have a 5 man operation, you expect one file server, and 5 workstations.
Maybe a second server for internet functions, depending upon what you do.

It seemed excessive for a company that never produced much of anything, imho.

No matter what anyone wants to make of this, the fact is that it is considered "Assets" that can be and is being converted to "cash". The fundamental point of interest is who is doing the conversion and why.

I can perhaps see a company converting some small percentage of their assets into cash, or even throwing such non-working or outdated equipment out, but neither is the case here.

It is a rather large amount of items in comparison to any external verified source of the actual size of Amiga Inc. Employee base.

And in any event it shows disregards for taking care of ones business. So what if it was an agreed upon exchange for back rent due?

Amiga decides they don't need the stuff and figure they will just let the landlord have it as payment for what can only be back rent, as Amiga is no longer there.

Then as a matter of Public interest then how about a verified statement from teh landlord to such an effect.

Maybe I'm being stupid here.... or maybe I'm just trying to find the most logical validateable excuse for this event.

Amiga decides to cut their losses in teh office space. They move in to MS property and proceed to work on MS products.... while being supported by MS....

Come on Ray AKey....... explain this in terms that are reasonable to suspend disbelief.......

I have no doubt that the manificent creativity of the all that Amiga is can fabricate an acceptable excuse.... true or false....

The grand plans Amiga Inc had to develope an online software rental system and collect royalities for some fraction of to redistribute back to the third party developers......

It fell thru....

Given the discription of the Trademark as Amiga Inc had it, further suggest this trademarked.... rental system was to be based upon software that was used to develop such rental software on.....

I am going to have to respectively disagree, there are 7 servers, plus 44 other computers, lots of printers, scanners, etc. All this for an office that held 10-12 at its peak. Wouldnt you agree that 30+ Vectras and 30+ 21" monitors is pretty silly when you never had 30 employees??? The PDA collection, most of us has seen most of those demoed at one time or another, having 1 of each type of item as you get your products to work on them is a good idea, fridge, foosball table, etc, pretty much non issues, but having 30+ PCs when you dont have 30+ employees is pretty silly. Hire a new employee, get a computer for him, maybe have a spare one around in case someones goes down, having 20 spare computers around with 21" monitors is just crazy.

When .info magazine went tits up in 1991, owing three or four months/issues' worth of writing fees to all of their freelance contracted writers (me amongst them), and owing their in house staff salary, similar to what Bolton Peck successfully sued Amiga Inc. for, what the inside staff couldn't grab with both arms and take home before the doors were locked got put up for sale in a tent auction in Iowa City, IA. I've got the flyer for the auction (there was no WWW then on which to post this sort of thing) and while I'm in no way inclined to type the whole list of auctioned inventory in, it included a LOT of Alpha and Beta software AND hardware and review hardware that .info had either under NDA or for review and return purposes. All of it was sold. Including computers with Beta version software on it.

So if you want to think that the hard drives in those soon to be auctioned Amiga Inc. computers contain nothing of importance, go ahead and think it. Obviously Murphy Auctions isn't going to list the contents of the hard drives. And the last entry in the inventory, "Misc. office supplies and much more".. well who knows what that could include..

Or to use Ray's style of obfuscation, "It says filing cabinets. It doesn't say there's anything in them, but it doesn't say there isn't anything in them either." But how anyone could look at that list and say it's just "some old furniture" I'll leave as an exercise to your imagination..
