Posted by Lando on 06-Oct-2003 00:48 GMT | Isn't this just a refusal to dismiss Amiga Inc's counterclaim as a sanction because McEwen didn't attend the last deposition? |

Thendic-Amiga Lawsuit Judge DENIIES Sanctions Against Amiga : Comment 2 of 94 | ANN.lu |
Posted by Rich Woods on 06-Oct-2003 00:51 GMT | In reply to Comment 1 (Lando): Pretty much so.
Now all Amiga has to do is get another attorney(s) - have them completely reveiw the case (money) and continue on as new counsel.
Wonder where the money will come from? |

Posted by Rich Woods on 06-Oct-2003 00:53 GMT | In reply to Comment 1 (Lando): Opps - reread it again - disregard previous post.
Basically the motion for sanctions by Thendic against Amiga for billyboy's conduct was dismissed by the judge. Effectively allowing the suit to continue with NO sanctions against Amiga (when they get new counsel of course). |

Posted by Rich Woods on 06-Oct-2003 02:50 GMT | In reply to Comment 4 (T_Bone): Yes - it is GOOD news for Amiga.
I have the feeling the judge is giving billyboy just enough rope to hang himself. Not knowing what was spoken between the various parties in regards to the "loss" of the lawyers - we can only speculate.
My "gut instinct" tells me the judge is allowing Amiga sufficent time to "hire" new lawyers.
If no new counsel is available - well we'll then see what happens. |

About Merlancia machine.. we all know such doesn't exist so there's nothing to dig about it :)
Besides, Amiga Inc. is more fun to follow.. it's like a re-run of the Mr.Bean episodes |

It's strange how people wanting to claim the moral high ground end up shooting themselves in the foot this way. If you really want to show some indignation about what Rich is doing, I suggest you try posting without tasteless sexual innuendos, etc.
As for who's "paying your expenses with regards to this Salem's Witch Trial", all he's doing is getting court records for a nominal fee and posting them, which doesn't really require heavy financial backing, no more expensive than anyone else's hobbies around here :-) .

documents that appeared on his website ( and the timing of each ) and when they
appeared.
It is called having an opinion about someone else based on observation."
Pray observe then. It's a positive turn. |

If I where the judge I go for some type of public service punishment,
I love to Se Bill Mac Even picking up trash in the park, empty bear-cans etc,
I mean the public should get some thing back for 50 bucks deal, and he probably needs the exercise to strengthen his hart any way. |

Eve is the name of the first lady in the world and other used by transvestites, as to indicate they are some kind of new bread or some thing, be quite sceptical about this, the seconded things that hits me is how many computer freaks are men and how many are women? I think the % is quite small, one more thing is Eve a woman’s name in very country? |

No need to wait for an end, just judge from current facts:
1) Amiga Inc can't even pay their attorneys (or they didn't believe in Amiga's possibility to pay and/or win).
2) Amiga Inc has already lost other cases (see all the moneys they owe to this or that guy).
3) Amiga Inc can't even peint t-shirts for people who deserve them.
4) Many Amiga Inc supporters are so worried for this situation that spend their time insulting.
And last but not last...
Dave Haynie doesn't believe in a future for AmigaOne.
http://amiga.org/modules/sections/index.php?op=viewarticle&artid=15
Maybe Amiga Inc(redible) supporters will call him a troll too, now?
It's too easy to talk about single acts of a legal procedure
that most people aren't able to fully understand. Amiga Inc
is in really serious problems and offending other people
while trying to deny this situation is just childish. |

Posted by Bill Hoggett on 06-Oct-2003 09:28 GMT | I must admit that I thought the motion for sanctions - and the sanction requested - looked unreasonable, so I'm glad the judge didn't allow himself to be bullied.
However, one should not start counting chickens. This does not absolve Amiga Inc of culpability, and they will lose the case by default unless they hire and brief new lawyers pretty quick.
In the context of their war for survival, this is a small skirmish that's gone Amiga Inc's way. |

Posted by MarkTime on 06-Oct-2003 12:08 GMT | I'll second other's thoughts.
Rich Wood's took a lot of heat and criticism, but has proven himself to
be a valuable contributor of information.
The reporting couldn't be more solid, its usually just the unvarnished facts with the briefest of summary's.
As far as this latest being good news, well...it reminds me of the old joke, someone asks you if you had a good weekend, and you respond, well, nobody went to prison if thats what you mean.
In other words, the failure of one attempt at sanctions is considered good news, then this is good news....but I rather think it is a sign of how far things have degraded, that the lack of horrible devastating bad news, is now, itself, good news. |

Diversity show some kind of intellect, good comment are not when you argue, but when you having a dialog, and can reflect different view in normal way.
I think my comment are reflecting what time of day they where written in many cases, if I comment in the morning they are sharp, if comment late at night, that become dreamy,
I tend to use irony, sarcasm and examples to make my option clear,
I think there are some that do not like my comment in every case, I do not band just to please one or tow, if I’m going to change my mind then they better have a valid argument.
And one more thing it’s a family value I never attack a person by calling him/her names, if ever comment on some thing, it will be in the best possible light,
In the case of Eve I where not comment on there person Eve, I have comment on the name Eve and the strange thing about a woman being in the Amiga/Morph forum.Personally I use a lot of time on comment that I should be spending on my projects, I’m doing a paint program as well as adventure game editor, it kind of moves slow…. I’m using SDL now, I might make a AROS port one day, when I translated ever thing from SVGALIB to SDL
Keep up the good work with AROS, and your have well balanced comment. |

This dismissal has merely to do with a motion filed by Thendic requesting sanctions on McEwan's behavior in regards to deposition process (his mystery health problems, delay's and flippant attitude during the deposition). The judge felt sanctions weren't warranted, although he put it on the record his disapproval of McEwan's behavior. |

---------------------
The judge is bending over backwards to allow Amiga EVERY possibility of a defense.
billyboy is probably talking about another "round of funding" - the judge is allowing enough time before the Dec trial date to allow billyboy to get new counsel and review the case and then to continue onward.
An interesting question will be where did Amiga acquire the funds to retain new counsel? A double edged sword.
If new counsel isn't obtained then Thendic will get a defaualt judgement on what they originally asked for anyway.
At this point - the ball is in billyboy's "court" - (pun intended) - right now it is up to him whether Amiga, Inc (as it presently is) lives or dies. |
