Motion for Summary Judgement Against Amiga to be Heard on Nov 21, 2003 in Washington Federal District Court. Motion for Summary Judgement Against Amiga to be Heard on Nov 21, 2003 in Washington Federal District Court.

It also looks like Amiga is again without counsel.

"This matter comes before the Court on "Plantiffs' Motion for Judgement and dismissal of Counter Claims for Lack of Representation." Although corporations must be represented by counsel, defendant's failure to retain new counsel has not yet been given rise to a sanctionable failure to prosecute. Plantiff's motion for judgement and dismissal of the counterclaims is DENIED. Defendant must, however, obtain counsel to defend this litigation if it hopes to avoid an adverse ruling on plaantiff's pending motion for summary judgement.

What's amusing is the idea that a federal judge is out to torpedo Amiga. (These conspiracy theories are great fun.) "The timing of all these legal attacks" depends on when judgements are made by the court; it's not in anyone else's power to release the news. Do you think, anyway, that anybody really would want to play down OS4 booting from a hard disk? For one thing, that's not exactly stop-the-press news, and for another, I think very few people have any problem with AmigaOS development. The problem party is Amiga, Inc., not Hyperion, IMHO. I don't think Genesi fears AOS4 being released.

Behavior? Nobody outside of the Amiga community knows about the slow start Amiga has had or how their initial partnerships died (bad planing and bad luck, etc.). Ex-Amiga users know very little of this... Morphos has no presence. Sure they made a few news posts for their PPC, but Genesi is still a hobby machine with a few hundred users and an odd market strategy. Don't kid yourselves that either Amiga or Genesi is on anyone's radar.

The point is the case wasn't thrown out as I mentioned - if it was a bs case it would have been thrown out in the preliminary hearings.

Point well made - suprising how these "theories" come out from those who know little or nothing about the court proceedings.

The court proceedings were "set in stone" many months ago by the judge - dates of discovery, trial etc. What Genesi or Amiga, INc does or doesnb't do, releases or doesn't release is irrelevant to the matter before the court (breach of contract).

Idiots - "news from the court" - like I control the timing or release of court documents prepared by the lawyers.

some people simply have no idea what is really going on. (Not aimed at you BTW) - just generally speaking about those who know little or nothing.

Genesi is handling their business affairs as they seem fit to do - the fact that they are attending trade shows, releasing a lot of software and ports and continuing along on their business plan is their business.

Amiga, Inc well - their name is being used and Hyperion, eyetech etc are handling their business plans with what they have to work with.

Actually both Genesi and Hyperion are needed for the future success of the Amiga BRAND NAME (certainly not the company Amiga, Inc).

Competition is always a good thing in the marketplace.

And for those who say different I am NOT affiliated with or receive any type of monies from Genesi - and I have already paid for OS4.0 - years ago - before the coupon scam - I "bought" the SDK pack - as expected Merlancia never delivered on the product.

So $100+ went down the drain - and I'll have to spend most likely the same amount - double or nothing - now I'm paying MS prices for OS4.0!

I think it's great he spends so much of his time stalking people, it just proves what kind of person he is. He's a negative person and I don't think there is anybody that likes him.

Sure, people that don't like Amiga Inc. tolerate him because of the material he provides, but I think even they are leery of Dick Wood's sanity.

Things like registering Merlancia.us just shows how childish he is. Plain and simple his probably about 5' 2", he got beat up a lot in Middle/High school, and now he likes playing the big man behind the computer and insulting people.

The part that makes me laugh is that he is completely incapable of having a conversation with someone. He immediately resorts to name calling. Even of people he's never talk to before.

Its funny Samface posted the same info on Friday, did he time it to the OS4 milestone as you call it as well??? Is Samface now part of the massive Genesi conspiracy against Amiga Inc that some of you believe exists?? I mean did Genesi force Amiga Inc to not pay their bills?? What I am claiming is that BillB's lawyers kick up a stink with his honour every time some important event happens. Most of the times they don't succeed, but some times they do. How long has the news of OS4 booting off disk been out for? I think that's plenty of time for these motivated pinstriped sharks to do their work.

I'd like to see amiga, INc (or Amiga the company - not the management) work with Genesi and others with money to build up the community.

It really is the only chance for the name Amiga to survive (with honor!) - and forget billyboy and the rest of the crew - they down for the count, forgotten and bankrupt.
