Well I guess December 12th WILL be the day. If billyboy does/doesn't show up in court without an attorney, or any motions are NOT filed it looks like Judge Lasnik will grant the motion for summary judgment.

He certainly has given billyboy EVERY chance in the book - there can be no appeal on this one (like Amiga could afford an attorney).

Just in time for OS 4.0!

The judge was being overly generous and cautious - he is leaving NO grounds for an appeal (like Amiga could afford one).

It is funny that billyboy said business obligations (!) prevented him from obtaining counsel! The judge must be falling all over himself after reading that.

I doubt it. Judges see silly excuses all day every day. The likelihood of Judge Lasnick finding this case even mildly interesting is very small.

You seem to be refering to text, at least I can't find in this thread...

Only "related" mention I can find, is "Just in time for OS 4.0!" And I can't see anything "bad" in that...

And in fact Amiga inc. going bankrupt before AOS4 release might actually mean _additional income_ for Hyperion (as they wouldn't have to pay A. Inc any license fees)

Hyperion has MANY times stated, that their deal on AOS4 is so good, that it would still be done, in unlikely case, that Amiga inc. went bankrupt.

Pretty poor tactics when you have to put words in my mouth. I sat across from Ben at the restaurant when attending Amiwest - I bear absolutely NO dislike for Hyperion.

As a matter of fact I feel quite sorry for them for the time, effort and money they spent and now having billyboy screw them up. People deserve to make money on their hard work and having an outside influence to cause substantial delays etc is not something I want to see.

And BTW, I'll by OS 4.0 when it comes out for my A4000 PPC. And where do you get the idea Amiga, Inc "owes" me $200? You like to put words in other people's mouths then pass it off as "truth". Maybe being a total jerk is one reason why you can go elsewhere for your "docs" and information.

Even that would be voidable by the court depending on when it occurred. There was a long thread (ok arguement) about this between Ben & I on the bunny, that came down too, even if the contract was voided by bankruptcy (as in my experience they usually are), Ben believed MAI would lend them money to buy Amiga Incs assets, and MAI was much larger then Thendic. I found that funny, because if an IP and license I needed were to go on sale, Thendic isnt the first company I would be worried about acquiring it. And frankly MAI as a publically traded company, isnt likely to give alot of money to buy Amiga Incs ashes.

To continue the speculation: Genesi, as a company, definitely would still
have "duty and honour" enough to keep the Amiga spirit going.

Why would we kill Eyetech off? HOW could we? They're a good reseller and they'r

Why can't we get the Hyperion guys to make some games for MorphOS? That's what
they do after all, game ports.

There's NO reason why a Genesi controlled Amiga future would be bad either
morally or financially for any party involved, apart from Amiga Inc. itself
as it stands currently!!

So all the negativity about how Genesi would be a bad thing for Amiga here,
needs to stop. This isn't a religion. We aren't on a holy war to fly planes
into Ben Hermans' office or drive car-bombs into the industrial estate where
Eyetech is based. There is no room here for spite.

I find it disappointing that people hate us so much. We don't hate as a
company, it's depressing to see so many "loyal customers" doing so as if it's a missing factor..

Thank you Neko, for revealing Genesi's plans on what to do after the Amiga IP fire-sale. We already guessed as much, Bill doesn't want to kill Eyetech or Hyperion as such, just get them out of the picture as far as selling Amiga stuff. Amiga Inc *has* to die though, what else are they going to sell? Your boss has behaved like monopolist since day 1, I wouldn't be surprised if he had an autographed picture of Bill Gates in his office.

Well it seems pretty obvious that Amiga Inc is going to be history before too long. I think all sides of the Amiga community will hapilly raise a glass to that! It'll be interesting to see what happens afterwards though. People here have speculated over who might buy Amiga Inc's assets. We might assume that their biggest asset would be AmigaOS, versions 1.0 - 3.1 (is 3.5 & 3.9 owned by Haage & Partner?), however, does Amiga Inc own AmigaOS any more.....? I am not so sure....

For my part, the key question is whether Genesi expends any efforts in further development of AOS4 - there's not a lot of sense in just arbitrarily binning it (if it really is "just two more weeks" away). I can see the sense in continuing to offer AOS4, but their strategic OS is MorphOS; if the trademarks fall their way and the MorphOS crew don't object, they can even rename MorphOS to some form of "AmigaOS".

However, while I can't see a clear motivation for continuing development of AOS(4) in-house, it seems reasonable to let Hyperion carry on with much the same arrangement as they currently have with AI; Genesi can give them a hand with keeping up with the Pegasos hardware, and concentrate their own efforts on MorphOS.

This leaves the question of whether Amiga API compatibility in MorphOS will continue to be a key feature; there are a lot of subjective variables affecting this, so I don't think I'll risk an opinion here.

Indeed. This could be very interesting. Supposing somebody was to buy up the name, along with the rights for AmigaOS 3.x after AInc dies, they would (presumably) also get the right to further development of AmigaOS, so we could be in a position of another "Official" AmigaOS 4 being developed, in addition to Hyperion's one.

Hyperion may have to change the name of their OS (Maybe "Hyperion OS4" or something) to avoid conflicting with the new owners. It would be a difficult time for the "name" followers - do they ditch HyperionOS and go with the new "NameOS" because it's "Official" and "Based on the 3.x source code" and has the "name"? Or do they stand by Hyperion?

Personally, I would stick with Hyperion. Don't really give a damn what the OS is called so long as I get it.
