Ravensdale, WA - 3:00 pm Pacific Time, March 15, 2004 - Amiga, Inc. announced today that it has sold the Amiga Operating System to KMOS, Inc, allowing Amiga, Inc to focus on the growing mobile market.

On April 23, 2003 Amiga entered into an Agreement with Itec LLC, later acquired by KMOS, Inc. for the transfer and sale of all of Amiga's right, title, source code, and all versions, from the "Classic Amiga Operating System" through AmigaOS 4.0 and all subsequent versions to KMOS, Inc. "The expanding mobile market offers Amiga over 200 million potential customers that we need to focus on," said Bill McEwen - President/CEO of Amiga, Inc. "We began looking for a company that could focus and provide proper resources for the AmigaOS and the associated markets and we found that with KMOS, Inc." McEwen Said.

"We welcome the acquisition of the AmigaOS intellectual property by KMOS. Together with KMOS, Hyperion looks forward to exploring new business opportunities for AmigaOS 4. I would like to reassure all our customers that the acquisition by KMOS will not have any adverse impact whatsoever on the release of the consumer version of AmigaOS 4.0 later this year." said Evert Carton, managing partner of Hyperion Entertainment VOF.

KMOS, Inc. is acquiring and developing technology enabling the company to participate in the worldwide communications market. Garry Hare, KMOS' CEO, said "KMOS is very excited about the commercial potential of this innovative operating system. At Amiga's insistence to which we totally agreed, we will honor the terms of the November 2001, agreement with Amiga One Partners: Hyperion VOF and Eyetech Group Ltd., an English Corporation, in their entirety. Mr. Hare continues, "I should point out, that except as they relate to the Amiga OS family of products, KMOS did not acquire the Amiga name, intellectual property or its DE line of products. There are more twists and turns in this saga than most novelists could ever dream up. Personally, I tire of poorly reasoned, argumentative opinions, and uninformed speculation. Why dosen't SOMEONE who actually knows what the h*ll is going on spell out something close to objective reality? Most here would probably benefit greatly from more facts and fewer editorials from the usual factions (both red and blue).

Oh, I did see something like this coming, unfortunately the proof of this my claim has been wiped out from the AmigaWorld.net database ;-)

And, btw, I must point out that back then, when I claimed that AInc could possibly decide to sell off their AmigaOS-related assets to someone else (I mentioned Hyperion, and apparently wasn't that far off), I've been told I couldn't be more wrong. Oh well... ;-)

I wonder if they (a) deliberatly lied for one year, faking the position of ownership (with Ask Fleecy Columns) or (b) backdate an agreement to get out of a hot spot? If it's the former, then the red side just continues with the innovative new idea to alienate their supporters as much as possible. If it's (b), then they might find themselves in jail cells pretty soon.

They sold the OS to KMOS. Now to which market segment are KMOS gonna sell it too? It's still a product that no one needs and that is more expensive than a similar and more powerful Mac. The market itself already chose it's new champion: Linux. The old niches market that the Amiga used to serve were filled by their competitors: Microsoft and Apple. Most Cell phones run on Java, most gamers have Windows and scientific community is embracing OSX. The multimedia community is stretched between MS, Apple and UNIX vendors.

Note that Linux in PPC world is not quite at the level of Linux as in X86 world e.g. Lindows 4.5 (Walmart PC). Apple’s hardware is not quite available as generic form factor (e.g. ATX, mini-ITX) i.e. refer to gutted PowerMac G5 scenario.

Well, that is Eyetech's problem. It is up to Alan to get out and sell his product, which he seems to be actively doing. There may well be markets out there that you have not thought of. It's a big world.

It is only a problem for Amiga users if the sales are so small that the OS ceases to be developed.

Bear in mind that all the companies involved are much more lean and fit than Commodore or Gateway - no big office blocks or warehouses or excecutive jets.

Hyperion works on different time scales. In the Hyperion universe, the terms "shortly", "in a few weeks", "before xmas" and "on schedule" have to be used carefully, taking into account that their developers code, think and move at the speed of light. Alas, as Einstein explains (theory of Special Relativity), that affects the intervals of time and of space. In a nutshell, physical laws delay the release of OS4 and the realization that AmigaOS was sold a year ago. From our un-accellerated perspective, they seem to move in slow motion. Anyway, it's hard to go downhill from rock bottom. Is it just Eyetech's rights to sell AmigaOS with whatever they want to label "AmigaOne"? Good for them, there's a sucker born every day, good luck, who cares?

Is the above under the current condition that AmigaOS will only be allowed to be sold bundled with "licensed hardware" from licensed vendors? The whole stinking "Amiga hardware market" charade we have today continues? Then AmigaOS is still dead.

Looks like interesting times ahead, no matter the outcome.

This release of information, as always, is way too incomplete to be useful. They acquired the rights to OS4 so they could concentrate on the mobile market.....well, thats good, but how do the two relate?

How was it possible to do if AmigaOS was sold for KMOS? Amiga Inc sold AmigaOS for KMOS and 8 months later they negotiate contract with Cloanto. Wtf?

Depends on how the sales go. If in 3 years time there are still only a couple of thousand Amigas in use, it will be time to stop development. If the profits are coming in nicely, it will continue.

The better the products that Eyetech and Hyperion produce, the better the chance of good sales.

IMO the key component now is the web browser. Until that is finished, sales will be hard to get.

But how could there have been a sale to begin with? We all remember the repeated assuring words ("in case AInc go bust") from Hyperion about them OWNING all work made on 4.0, with a buyback option open for AInc. ("Buyback"? As if any of Hyperion's stuff came from AInc to begin with.)

I've forgotten how the "bankruptcy proof" contract theory was supposed to fit in with that story.

Read it again. Amiga Inc _sold_ the rights to AmigaOS, so that they could concentrate on the mobile market (ie DE). The DE was what they were lent money to work on, in the first place.

Garry Hare _bought_ the rights. We don't yet know his long term plans, but he appears to have a much more solid industry background than Bill or fleecy.
