While many people talk about people suing Amiga to make Amiga bankrupt or some such nonsense the truth is Amiga did it to themselves.

Here are copies of Amiga's default judgement to their landlord - The Inception Group (Thomas Clary) - who happens to be a gentleman and a very honest guy.

Parts of Amiga's belongings that weren't sold at auction but which were sold to me (for the sum of $500) are included in the respa statement submitted to the courts. An EXTREMELY honest accounting of monies generated by the auction. I may make the auction proceeds available at a later date.

Amiga's lease called for payments of $14,144/month to $15,002/month.

The judgement carried an interest rate of 12% per annum - meaning Amiga is accumulating more debt at a rate of an additional $1,470 per month.

This doesn't include all the other judgements and interest accumulating also.

company away from bankruptcy regardless what debts it has? Here a
company behaving like this would definitely have been shut down a long
time ago.

I think (IMHO) there are things going on behind the scenes to have Amiga declared bankrupt. Also there appears to be MORE criminal actions in Amiga moving around IP assests to avoid payment to judgement creditors.

This should be obvvious to even a blind man.

billyboy's first eviction (1988) and his constant and continuous defiance of the courts (almost NEVER showing up in legal actions) show the type of individual he is.

ANYTHING to get OVER ON ANYBODY.

His personal Bank of Amnerica credit card default in the amount of $10,000+ - default judgement.

Maybe I'll post the court docs - might help open someone's eyes.

Contacting Tom Clary (and leaving several messages on Amiga's new situation)- Amiga's landlord - there could be something happening along the lines you suggest.

Garry Hare (and shareholders) might regret the actions being taken - I have a gut feeling the shit will REALLY start hitting the fan. billyboy just may be on the run this time.

And that's for just that one judgement!

I don't think anything Amiga Inc could do would ever get over this tidal wave of accumulating debt. They're f****d. No wonder they're sneaking assets out the back door to shell companies. if I were an employee owed money by Amiga, I'd be raising a huge stink. if it wern't for BBRV and his lawsuit, the employees wouldn't even know this was happening.

How many people did Amiga Inc. have working for them in the offices at that time? 5? 10?

Let's assume 10.

A person requires 80 to 100 square foot to work in. Let's assume that 3 people got bigger working areas. Add on a coffee area, meeting table, etc. Let's assume 2000 square foot in total.

In the UK, in Cambridge, office space is between £10/sq. ft. and £20/sq ft. per year. That would be £20,000 to £40,000 per year for Amiga Inc to run up. However they weren't located in an expensive area as far as I am aware.

I just can't see how they ran up massive debts of that scale renting offices? If they made the mistake of getting fully managed offices (desks, computers, IT, support, telephone, blah blah) then maybe, just maybe.

So either Amiga Inc were stupid and went for way too much office space for their size and needs. Or they were stupid and went for deluxe offices when they only needed basic offices. You would have hoped they would have looked at their cash reserves and projected cashflow in order to decide what offices to go for.

A start-up or small company going for offices should go for the most basic one that meets their needs, possibly with room to grow as an option they can take up. You then buy 3rd hand office furniture for dirt cheap to fill it out. You get the bare minimum of services you need, not a 10Mbit leased line with Cisco IP phones and all that. Maybe they committed to lovely nice offices and then investors pulled out, so instead of $millions they got $thousands.

It really doesn't say much for Amiga Inc's collective intellect to be honest.

(at least 30 or so, based on numbners of 'excess' computers and other 'unneeded' equipment auctioned by Ex-landlord). So IMHO you should at least triple room space and estimated rent.

And,.. In last summer McEwen testified comany having (Still, after years of nonpayments and othet misdeeds) over 10 people 'working'.. IIRC it was 12 total.

Even so, if you cram them in, at 80 sq. ft a person (still more than enough room for a standard office worker/programmer) that is 2400 sq. ft. + 100sq ft for coffee area, 200sq ft for a seating/meeting area, another 150sq ft for a small meeting room, and 100sq ft for more important people - I'm sure they could have fitted everyone + storage, etc, into 3000 - 4000 sq. ft.

Still, I forgot to account for A/C and similar bills. Usually these are included in office rental though.

Amiga Inc. clearly suck at teh accounting.

Realize the offices in question were over 10,000 square foot according to Luca Diana's visit report, and Bill McEwens comment when they moved in. I really don't think each employee having 1000 sq ft is necessary, but thats what they rented at a pretty good rate per square foot, but alot of square footage.

This plan is impossible now, as Amiga Inc's debts are greater than their assets, and one would be a fool to buy Amiga Inc and aquire these debts.

Ah, so they took out more than twice what they required. That was pretty stupid of them, in my opinion.

Maybe they thought they would be at 50 to 80 employees within a year? That would be stupid, they must have head their heads in the clouds when making their forecasts.

No company should give each employee 300 sq. ft. of space on average. No matter how good the deal is per square foot (sounds like it was around $10 a square foot, which is a nice deal). That is allowing the company to expand to three times its size. Stupid. Their investors should have stepped in and said "hang on, go for this 4000 sq. ft. place at $14 a square foot instead.

Real expensive network equipment, 7 dedicated servers and over 40 PC:s (most computers are Name-brand), Over 40 Monitors.. (over 30 of them 20 Inch or bigger) etc etc etc.. All this was left behind by AmigaInc late 2002, and sold by Landlord to cover part of the Debt.

When we take into account the McEven testify about their remainign workers still having their work-PC:s (apparently carried away before doors were closed)... Total number of Personal Computers on Amigainc goes over 50...

I'm not saying there would have ever been 50+ people, but number of nearly identical HP Vectra systems (over 30) remainign for sale seems a strong indication of work staff.

For the sake on completeness, it was stated at the time of the auction that not all items auctioned were Amiga Inc.'s. Those numbers may have, if those accounts are true, included computers from other companies that were auctioned at the same time.

Rich pursues it with an intensity that makes one look twice, but the fact that he puts up these documents is a real net benefit to the community (such as it is) in dispelling the routine deception and misdirection that was always Amiga Inc.'s way of doing business.

Spin is the repellent moral phenomenon of our age, and Rich dispels Amiga Inc. spin. For example when they were evicted they covered it up for months, then they said they were just auctioning off some excess obsolete equipment, in the meantime they ran their coupon & t-shirt swindle and nobody ever got any coupons or t-shirts yet.

So IMO this specific thing with public documents that Rich does is a good thing for everyone but the swindlers. We need more outrage in this world at the spin and deception that is not only used by business people but by political leaders.

The irregularity of the KMOS thing (the back-dating and "iTec" parts of it, as well as McEwen's conflicting deposition testimony as to who owned what when) call suspicion to KMOS.

The possibility that KMOS is a shell company set up to steer funds to McEwen, Moss and co. instead of to creditors in the long-overdue event of an Amiga Inc. bankruptcy is a possibility worth looking into.

That's correct. I'll probably buy one sooner or later. I'm using my Amiga A4000 with a 060 PPC card. And when OS 4 comes out (assuming I'm still alive) I'll buy it (having really paid for it already with the SDK purchase).

Hell having Amiga's since August of 1985 - does that put me in the "red" camp?

I've "seen" McEwen's office -- there was a nice big picture in the New York Times article, remember that? Fairly standard stuff, Staples-grade office furniture, building was fairly new construction, looked like a nice place to work, if a little bluish in the shot.

Now, you have to take this in contrast this to the average .bomb, which would've generally started in someone's bedroom, and gone straight to prime real estate in the likes of San Francisco or worse (possibly skipping stage 1), blowing a couple hundred thousand on Aeron chairs and the like. Everyone was playing the image game, trying to look hip and successful, and keep the VCs comfortable while hammering out their next rounds.

In contrast to that, AI's initial accomodations were fairly sensible. (Wonder if that $14k was carrying markup for the era?)

The problem was and remains the product; it's ridiculously expensive to fund and wait out actual development, especially when everyone else is just scripting glue or bundling Linux. Even harder if you alienate your coders or they weren't willing to play by your plan in the first place. (No offense to Bolton at this point, if that insurance thing went down it's grounds for losing rational thought, but from the outside, he sure did run 'quick' to founding the 'Snoqualmie Pegasos Users Group.' Are there any names who aren't on the list of complaining employees?)

Someone was going on about Gary Peake having a private T1; smells like rumor, but it could be that bad business calls like this were where the money was sunk instead (SDSL was still a bit rare then, don't forget) ... Plenty of companies went bankrupt buying Cisco.

Real expensive network equipment, 7 dedicated servers and over 40 PC:s (most computers are Name-brand), Over 40 Monitors.. (over 30 of them 20 Inch or bigger) etc etc etc.. All this was left behind by AmigaInc late 2002, and sold by Landlord to cover part of the Debt.



Since I bought a large majority of the stuff (which I still have) I can vouch for this. I have 2 of the servers and numerous Gateway systems - haven't put em up on ebay yet but will sooner or later.

If requested I guess I can scan the proceed information from the auction - (6 pages).

That is correct - the larger monitors (21") IIRC weren't Amiga's but office equipment from other companies. And some of the computer systems also.

If you mean the case with the landlord - it was in Nov that the final judgement was decreed.

And I have MANY documents and internal memos etc that have never been brought to light. (I have billyboy's Mastercard application from Gateway!).

I have extensive pictures of the auction and of their offices - before, during and after the auction.

The auction ended and I was at Amiga's offices packing PALLETS of boxes (over 50) - I was there for literally 12 hours per day for 4-5 days.

I busted my chops. Hardly did any sightseeing - it was strictly business and a heck of a lot of hard work.

If people want - I can post pictures of Amiga's offices, auction etc.

Videotape and stills.

And sad to say, I was the LAST person in Amiga's office to literally turn out the lights. Can't tell you how sad that was, personally for me, after 15+ of using Amigas.
