You know exactly the problem: As long as you do not accept the licence for OS4 from Amiga Inc. Hyperion is not allowed to make (and sell) OS4 for the Pegasos. So first of all do not blame Hyperion for not making something illegal but Amiga Inc. for wanting a licence.
HJF wrote also (on amiga-news.de) that bplan simly didn't want to give any information about the Pegasos to Hyperion, that was before the licence from Amiga Inc. was born and needed, so OS4 would be in development for Pegasos today, if bplan would have beeen cooperative. So interest in developing for Pegasos was always there, just ignored.
Last but not least, the only "proper legal approach" today, to get OS4 to Pegasos is to acquire a licence from Amiga Inc. for the Pegasos. As long as noone does this - and Genesi seems not to do so - there can be no legal OS4 for it. That's a simple fact, even if you would give Hyperion 500 boards and pay a flight around the world, it wouldn't change anything with the legal status.
