I have had Kevins so called copyrighted pictures on my website for many years without anyone complaining to my isp, this issue is all personal nothing more nothing less,
Will i take off all your pictures from my site? No chance i even have the logos of cucug and awd on the bottom of the pages, so i will continue to use them,
copyright LOL.

IMO we need to respect eachother's property, nomatter if you like someone or not. As long as Kevin sees no harm in you mirroring his pictures, you can continue to do so, but IMO you should have asked him in the first place.
Many people contact me if it is OK for them to translate or re-publish my OSNews articles. They need to follow some basic conditions, I would not like them to do this without asking me first.

I was threatened with "legal action" in 1998 when I maintained AmiUpdate (http://www.amiupdate.8m.com) - and shortly after that, after getting hatemail etc, I just threw in the towel.

I think it boils down to one little guy...without a grain proof... getting angry because his site AWD went down and nobody even cares really that it's gone... we all migrated elseware.. some bald/middle aged/angry/bitter/vile little people will hang on and try to bring down good things any way they can... fact is throwing 'copyright kevin hisel' on a group of images then not really copyrighting them does nothing... copyright grace period is 1 year and it expired in 1998... so if you wanted to keep those your intellectual property you would have needed to actually copyright them with a recognised institution... therefore you're just a loser... I'm happy AWD went down.. it sucked compared to A.org anyway...

What a crock of nonsense. There is no copyright grace period. You have 90 days to register a copyright, but only if you plan to register it. You don't have to register it at all, and the copyright is granted automatically at time of conception.
This is the United States, btw, so I am not commenting on another countries law, and I am especially not commenting on the law of outer-fruitopia...or wherever you probably live.
Anyway, Mr. Kevin Hisel, who I don't know at all, is obviously in the right here...it never gets more obvious in disputes of this nature.
Wayne claiming, that AFTER the fact, that some crony now claims he got the photo's on a zip disk....what nonsense, and you know what, Mr.Hisel claims he developed the photo's and then scanned them in...well if he has the negatives or even the original's which are of higher quality than the digital copies....
that ends it all, PROOF positive he is the copyright owner. That's all thats needed...remember this is civil law, not criminal, you can go into theories about faking photographs and gloves not fitting all you want.
now how in the world is Kevin supposed to prove in a posting to ANN.LU that he has proof....or to Wayne for that matter in an e-mail???
There is no way at all, in the long run, the only way he can prove himself is in court, but he had no need to go to court, because he got the pictures removed...its up to Wayne to go to court, if he wants, and thats just the law, and if he doesn't like it, he can write his senator.

Wayne is claiming that he responded to me three times. I never received any responses from him. I filed the DMCA complaint after reading in a forum that he was purposefully ignoring my requests. This is from the Amiga Realm forum via Google's Cache at:

Personally, I believe your both most likely twisting the facts. Thats just a natural thing to do during this type of debate.
But i think your just an ass for even bothering with this whole affair in the first place. No proof needed.
BTW, kevin, instead of hearing second hand information from third parties, I would like you to tell us how many amiga sites/people you have threatened with legal action or the like based on copyright or a similar basis. I would like to know if there is indeed any merit to people saying you have a "history" of this sort of behaviour.

I wonder, has anyone tried verifying the purported copyright notice by way of http://web.archive.org/collections/web.html to see if the "don't use without asking me" clause actually appeared there? This would help to determine if he DID, as some guy suggested, actually tack that clause on after the fact...
Course, if that editor who allegedly provided the pics on a zip disk now shows up and states that in fact he DID provide everyone with those pics on a zip disk AND identifies, verifiably, where they came from (and it turns out to be somewhere OTHER than via Kevin Hisel), then Kevin will have plenty of egg on his face.
By the same token, if Kevin Hisel produces the original photographs, then Wayne Hunt will have egg on HIS face.
Either way, though, this whole thing looks really stinky and OTT.
