If you were to check your AmigaOS 3.9 software, you'll notice all the OS components and stuff have an Amiga copyright message, not a Haage & Partner one.
I obviously don't know the details, but I'm told Amiga Inc are the copyright holders and can distribute OS 3.9 as they like. However, for reasons best known to themselves, of source code to the OS 3.9 additions was not covered, so H&P require Amiga Inc to buy those back before they will release them, which Amiga Inc are unwilling to do.
It does look like Haage & Parner actually OWNING OS3.9 is a bit of a myth, but I suspect the full details of that particular deal to be extremely murky.
