Nova Design Obtains a Judgement of $270,000 against Ryan E. A. Czerwinski : Comment 103 of 108 | ANN.lu |

It's not quite that simple. There's little doubt that Amiga Inc mishandled their dealings with H&P, but your comment implies that the fault is their alone. This is certainly not the impression I get.
As Bernie said, in the case of Amithlon/AmigaXL there was NO contract. That is to say H&P _refused_ to sign the contract, so it's hard to see how responsibility for that lies with Amiga Inc. Note also that H&P themselves never claimed they didn't owe Amiga Inc a licensing fee. According to Mr Haage, they were "waiting to receive the invoice" first (which seems a bit difficult in the absence of a contract or Amiga Inc receiving any sales reports). It's quite obvious H&P thought "screw them, they'll never come after us anyway", and were proved quite right in that respect.
However, I think the person initially responsible for the bad relationship between Amiga Inc and H&P is a former high profile Amiga employee who was notorious for making up his own rules as he went along. Many Amigans still revere his contribution, but in reality he left a legacy of corruption and total disregard for rights and contracts. I am of the opinion that the damage he did by far overshadows any of the stop gap measures he took to "keep the dream alive".
I think the current mob are responsible for enough cock-ups without being blamed for others' lack of professionalism too. |
