At today's hearing of the Tribunal of Commerce in Paris a judgment was rendered declaring Pretory, S.A. in bankruptcy and appointing a receiver. The process finally will now begin to transfer Thendic-France's assets to Genesi SARL.
Our situation with Pretory S.A. has been a long and difficult one. In all matters we have cooperated with the French Government and agreed to close the Company in a coordinated and proper manner. Time will demonstrate that we have behaved properly and legally in all respects as shareholders and managers.
In no way will these matters effect Genesi. Finally, we are personally free to devote the time and resources we want to the Genesi.

Posted by gary_c on 20-Nov-2003 06:15 GMT | In reply to Comment 149 (DaveP): Considering the fact that Dave Haynie can have civil discussions with Bill Buck and others involved with the Pegasos on the Phoenix mailing list, etc., the legal status of the code doesn't seem to be much of an issue, at least on that level. MorphOS has been the topic a number of times and the question of stolen code never came up. The future prospects of the platform have been discussed by these guys and the legality of the code never came up. More important things like what demand does it meet, what market does it serve, what capabilities does it have and so on were the focus, as they should be. So I'd say it's a nonissue as far as these people are concerned. If it's an issue for Amiga, Inc., that company should have pursued it back when they were throwing the accusations around. If they had a viable case, they should have backed up their words with action. I think the reasonable conclusion is that they didn't and don't have a case. People who still claim they do apparently don't have all the information.
