I am currently being threatened by my former employer (they are "compelled [to] take action against [me]") for the way I am running ANN, and how this allegedly violates my employment contract with them ("interfere _in any manner_ with any business relationship between the Company and any of its customers or business partners"). This might entail drastic changes to the relative freedom of speech ANN has always allowed its visitors, or ANN might close down altogether. Updated 10:00 CET.

Hi Rich Woods,

It was at first a 2 or 3 line post (by Christian Kemp), rather vague, with few details, and I was upset that a public forum was attempted to be muzzled; you should appreciate that.

>> I apologize to Rich Woods. You are the second person that I thought may have
>> been behind this.
-------------------------

> And now you speculate I had something to do or was behind this "situation"
> shall we say.

AFTER, I found out who was the party that was behind it, which is AFTER I had already said that I thought of TWO people that might do this, I SAID who I thought might have been the other person. I didn't need to EVER say who I thought the other person is.

> Sheesh - I have tried to make sure Christian got his 10% of the money I spend
> on Dreamhost - and also 1 or more donations to his site for his expenses of
> running ANN.

I WILL try to send Christian something, too.

> You really owe me an apology - not that I expect you would ever give one -
> but just to make the "situation" public.

I have quoted your comment 149, which has a quote of mine, from comment 56.

Did I not in fact apologize? Seeing as I did, it is for you to accept or reject it. (Unless you still hold to the above quoted sentence.)

I have to be even more careful when saying things in the future.

I also did not need to tell you what I was thinking, either, but I'm not like that. I speak about me, and am not making any speculation about anyone else, in this statement.

He didn't, he did ot say on what medium the threat of a lawsuit was transmitted, could have been email, fax, voice, etc etc

Also, the lack of responce from BBRV seems to imply that he is atleast aware of the threat towards Christian.

Christian - There is no need to close ANN - for a start you dont actually own it as you sold it about a year ago remember?! ;)

TBH if there is any threat I wouldnt worry. For a start Genesi *knew perfectly well who they hired and what that "baggage" that entailed* - and possibly thought it might even work to their advantage...

If Buck touches this board, I'm putting a stop on the check I just mailed them. I'd rather have my message boards than deal with a crooked company. Companies come and go, but these message boards remain with us even when the companies fail. (As this one is likely to, if they keep running the company this way)

A categoric declaration by BBRV that he is not taking any action against Christian for any of ANN's content up to this point would have totally shot the claim to pieces. Of course, it would also have shot any planned action to pieces, but if no such thing was planned, why care? "

Even if there was a denial from BBRV it could mean nothing... or just that he was dropping the case

It's obviously a lot to do with The Trial. I bet the recent round of subissions mainly from forum posts must have caused BB and his big mouth a lot of problems.

This could be a desperate attempt to get rid of that evidence, get ANN taken down at least temporarily, or force the removal of certain posts. I don't see how it will help really, at this stage.

But at the moment I bet BB is really pissed off at having his own words used against him like that. IMHO he got exactly what he deserved for manipulating people in such a way.

I'm sure we'll hear more soon..

That`s right, freeserve in the UK were involved in a similar action.

freeserve claimed a "common carrier" defense. Like the post office or telephone companies they were not publishers of a libel.

This was overruled as they had been notified several times of the libel.

Common carriers do not edit or oversee content.

However, there are many defenses. "fair comment", opinion, and the fact that if informed he would remove, instant right to reply, overall balance etc.

Explain their monster 14n digital SLR then. Talk about losses. They should have augmented their product line with an affordable semi-pro digital SLR also, as a means to get money from the guys buying point & shoot digitals, while waiting for the big boys to go into hawk to get the 14 Mpx monster. :)

Interestingly enough, though I personally won't buy one since I have invested too much $$ into Canon lenses to switch now, Nikon has released their product response to the Rebel; the Nikon D70.

It would be a huge waste of time. Anyone who "needs" anything from any of these message boards, already has it.

Take myself, for instance.. I have spidered them all (even ANN; manually, since no respectful spidering software will touch it) and have local copies of any and all of the recent postings which certain parties find useful.

Besides, there's web.archive.org, which doesn't archive ANN due to its respect for robots.txt but helps to find "old" postings on most other sites (yes, including amiga.com).

In Italy Andrea is, 99% of the times, a male name. Well, it is in my case, at least.;) Anyway, it's one of the most used, even. I know that in Germany, for instance, it's mainly feminine (once I wrote to the german author of a freeware program, and had probably the fastest reply in my life: bottom line is he was asking whether I was a girl or not)...

"And here i am, stuck with a Sony Cybershot P71, and being happy with it even ;)"

Actually, I was pretty happy with the Sony DSC-F707 digital that I still own and use for macro work.

I just had the itch to get into digital SLR. Not only is the optical viewfinder (as opposed to most digitals' electronic viewfinder) much more pleasant when composing a shot, it is almost necessary to get any decent kind of action shot, which is my main reason for buying an SLR.

Besides, I'm a wildlife nut. Shooting wildlife requires a lot less shutter lag than most "prosumer" digitals exhibit. Besides, it is much more fun to go out hiking or trailing and taking pictures of the sights and wildlife than it is getting all caught up in long-winded threads on message boards. :)
