Defendant's counterclaim is hereby dismissed for failure to prosecute. However, the Court declines to rule on plaintiffs' request for specific performance at this time. Plaintiffs' motion for summary judgment is renoted for 1/16/2004. Plaintiffs shall have until Monday, January 12, 2004 to submit a memorandum in response to the issues and concerns raised in this Order. Defendant, if and only if it retains counsel in the interim, may file a reply memorandum no later than 4:30 p.m. on Thursday, January 15, 2004. No extensions shall be given.

Posted by jules_s on 23-Dec-2003 10:28 GMT | In reply to Comment 207 (Matt Parsons): If that were the case, I'd say Mr McEwen would jump at the opportunity to declare bankruptsy. However, he seems to be hanging on for all he can. That's not the action of someone who stands to pocket shed loads of cash at the prospect of officially going bust.
To me his actions are that of a person who has everything riding on this company. i.e. he does not have any hidden stash of cash. if he did, he could get himself out of the mire by either offloading Amiga Inc (through sale or bunkruptsy) or by injecting some of his stashed money into rescuing said company. There would simply be no reason for him to hang on for dear life.
