A highlight from the latest ruling by Judge Lasnik:
Defendant's counterclaim is hereby dismissed for failure to prosecute. However, the Court declines to rule on plaintiffs' request for specific performance at this time. Plaintiffs' motion for summary judgment is renoted for 1/16/2004. Plaintiffs shall have until Monday, January 12, 2004 to submit a memorandum in response to the issues and concerns raised in this Order. Defendant, if and only if it retains counsel in the interim, may file a reply memorandum no later than 4:30 p.m. on Thursday, January 15, 2004. No extensions shall be given.

According to Amiga Inc.'s CTO Fleecy Moss, they do have the control of the development process and the feature set for the product has been made in collaboration with Amiga Inc. From http://amigaworld.net/modules/fleecymoss/index.php?cat_id=9:
"Far too much has been made of the fact that ownership of the AmigaOS rests with Hyperion at the moment, mostly by those with an interest in encouraging mischief. It was done as a protective measure to ensure that if anything happened to Amiga Inc then the community wouldn't have to put up with another x years of uncertainty. The actual development process itself is already well documented and agreed at the highest levels."
Since the product Hyperion will be selling has a feature set controlled and maintained by Amiga Inc., is making use of Amiga Inc.'s brand, contains other various intellectual properties owned by Amiga Inc., I'd say it's only their own additions to Amiga Inc.'s property that Hyperion do own. But even that is restricted by an agreement to reassert the ownership to Amiga Inc. within an indefinite period of time. Furthermore, Ben Hermans statement that they cannot do an x86 version of AmigaOS4 because they only have a license from Amiga Inc. for doing a PPC version is a good example of how Hyperion has certain restrictions of what they can or cannot do with AmigaOS4.
This means that Amiga Inc. controls it, owns it in part, has an agreement giving them the rights to reassert complete ownership, and Hyperion cannot do anything with the product besides what their agreement with Amiga Inc. permits. Do you still think Amiga Inc. has no rights to AmigaOS4 and is in complete loss of control over development?
I'm telling you, while Hyperion do have certain ownership to their commissioned work, Amiga Inc. is still the true owners. The ownership clauses is only a measure for protecting the product's future in case of any party becoming insolvent. This doesn't change the fact that Hyperion is only doing this as a commissional work for Amiga Inc. and they don't plan to take over the complete ownership of AmigaOS unless something would happen to Amiga Inc.
