A highlight from the latest ruling by Judge Lasnik:
Defendant's counterclaim is hereby dismissed for failure to prosecute. However, the Court declines to rule on plaintiffs' request for specific performance at this time. Plaintiffs' motion for summary judgment is renoted for 1/16/2004. Plaintiffs shall have until Monday, January 12, 2004 to submit a memorandum in response to the issues and concerns raised in this Order. Defendant, if and only if it retains counsel in the interim, may file a reply memorandum no later than 4:30 p.m. on Thursday, January 15, 2004. No extensions shall be given.

It's not the point that it didn't exist then. It's that Thendic think it's
unreasonable for Amiga to have skirted the issue for so long, produced nothing,
and now seem to be (conspiracies ahoy..) conveniently ignoring the Pegasos and
merely laughing away any attempt to get the DE or any other project onto the
platform.
The Pegasos *was* a future device, Thendic never said it should have been
*AUTOMATICALLY* added, but Amiga never cooperated in any way to validating the
Pegasos for inclusion. And bbrv certainly offered devices.
AmigaOS 4.x is not the issue at all.
But you could say that if Amiga are willing to push the AmigaDE to the
platform, AmigaOS 4.x may as well follow: of course Amiga Inc. have been shown
to be unwilling to deal with Thendic the moment it stopped being simply Bill
Buck & friends, and turned into Genesi - the official addition of bPlan
(phase5 & Ralph Schmidt) "tainted the water", and Amiga refuse to drink.
What Thendic is trying to put across is: Amiga Inc. are contracted to at least
taste the water, however dirty they think it is.
