A highlight from the latest ruling by Judge Lasnik:
Defendant's counterclaim is hereby dismissed for failure to prosecute. However, the Court declines to rule on plaintiffs' request for specific performance at this time. Plaintiffs' motion for summary judgment is renoted for 1/16/2004. Plaintiffs shall have until Monday, January 12, 2004 to submit a memorandum in response to the issues and concerns raised in this Order. Defendant, if and only if it retains counsel in the interim, may file a reply memorandum no later than 4:30 p.m. on Thursday, January 15, 2004. No extensions shall be given.

Posted by samface on 21-Dec-2003 23:40 GMT | In reply to Comment 56 (Bill Hoggett): Perhaps it would be easier to discuss this issue if we agree to certain common interpretations of the words we use. Let's begin with the definition of "outsource" (from http://www.dictionary.com):
To send out (work, for example) to an outside provider or manufacturer in order to cut costs.
The fact that Hyperion will retain ownership of the source codes they produce for as long as their agreement with Amiga Inc. remains in effect does not change the fact that Amiga Inc. is still in control of the development process and has an agreement with Hyperion to reassert the ownership within an indefinitive period of time.
Furthermore, the product is marketed under Amiga Inc.'s brand and the original AmigaOS3.x intellectual property, including the source code and the patents which the product is based on, is merely licensed to Hyperion rather than given to them as a right of possession. This means that as long as Amiga Inc. is still in business, Hyperion cannot claim *complete* ownership of the product because Amiga Inc. owns certain parts and rights to it.
Saying that AmigaOS4 has nothing to do with Amiga Inc. and/or that it wouldn't be a part of Amiga Inc.'s product portfolio is bullocks. Amiga Inc.'s entire future product line is depending on it. |
