Amigo follows up on serious allegations about H&P and says: "I also just asked Unisys as it says here, and am waiting for a reply. If true, H&P could probably be forced to close."
[ If H&P indeed didn't pay royalties for Unisys' GIF algorithm, they might not be forced to close per se, but if this is indeed true, and Unisys decides to sue, they might have to pay some serious fines. Also note that while this is not in unmoderated, it's highly speculative, unconfirmed and generally should be taken with the usual grain of salt - CK ]

Chris Wiles, there are two alternatives:
1) the contract spells out clearly that the contract includes the
rights for AmiTCP
2) they don't
In case 2), the AmiTCP authors then display the publicly distributed
copyright information for Genesis, which says clearly that AmiTCP is
copyright NSDi (Or preferrably, if this information has not been
removed in the H&P distribution, they might take it from there even).
Then they claim that H&P had no valid reason to believe they aquired a
license that covered AmiTCP.
Then the burden of proof is back with H&P again. Wiles doesn't
have to be involved unless there is something questionable in the
contract he signed.
However, this court business is of course going to be rather
expensive, and if H&P think 10000USD is a very large sum, then I'd try
every other possibility before turning to a court if I were the
copyright holders. |
