i noticed a new video on aminet:

the download is still in progress, but i'm sure it will finish to convince all amiga users thats the ppc amiga they are waiting since years is finally arrived

You don't need to prove that Mr Schmidt ever saw the source. All you need to do is convince the judge and jury in the case. And if what Fleecy said is true (bPlan are in, or were in, possession of AmigaOS source code) then the above logic will not look good for bPlan.
Along with arguments like "AmigaOS was in development from 1984 to 1992 with a large team of developers. However, the defendent claims that they have replicated the entire OS independently with a smaller team of developers in just 1/3rd of the time, whilst simultaneously writing their own OS underneath. However, we put it to the court that they couldn't have done this at this speed without making use of the source code that we have established that they had."
